They applied inland with owp (an a company hiring letter) but PA visa was expiring so he decided to return to the states to wait for his pr application. However they applied inland.. And he is back home, will that affect his application ?
 
I believe the applicant must be living in canada while an inland app is being processed. He can leave for a week or two but would think he needs to live here. Thay to me is misrepresentation as he is not physically present in canada. Applying for the owp gave him implied status. There was no need to leave
 
I don't know was it miscommunication through the border police that he cannot extend his visitor visa. I thought it was odd as they been married over decades but reside in states till last yr decided to move back. He is planning to come back after he get his owp but is it possible to wait outside Canada?

No - it's not. Inland requires you to be in Canada and living with your sponsor to apply.
 
I have a feeling they might get into some issues, as they are overwhelmed with immigration paper stuff n i wana help but didnt wana interfere unless they ask me. Cant do much now i guess.

But when he tried to go border to get his visitor visa extend, they told him they cant n ask him to go back to the states. He thought no choice but to leave

He shouldn't have gone to the border - that was unfortunately the wrong thing to do. Since he applied inland and included an OWP, this gave him implied status to remain in Canada until a decision in the sponsorship application was made.
 
So he needs to come back to Canada so as not to affect his inland application? He left abt a month ago, if he comes back in a weeks time, will that be ok?

I dont think they can change their pr application from inland to outland now right?
 
He should return as soon as possible. The longer he is out, the more likely CIC is to find out and then refuse his application.

It's not possible to switch an inland application to an outland application. To switch, you would have to withdraw the inland and apply from scratch outland.
 
Well, i guess they decide to wait till his owp approve thn he will come into canada so as he can still work in US. I did msg her but she never wana talk about it. Cant force somebody to listen afterall.
