apply from inside canada but husband in another province?

Hi guys !
After many years I'm now very close to be eligible to apply for PR from BC, me and my husband are currently working here with a valid work permit each.

Recently my husband got a job offer from Montreal, and it's gonna be a pity to refuse it since it's a very good position....
So we were thinking that he will be the only one moving in Quebec, while I stay with my current employer in BC and apply for PR for both, then I will move to Montreal as well.

Can I Do PR application inluding my husband even if he will reside in another Province??

we don't want to apply for PR from Quebec since we will have to wait at least 1 year more before be eligible :(

I know If I do the application by myself, then I can sponsor my husband.... but it will take a year as well for him to be a permanent resident... we are honestly tired of all the bureaucracy after many years we are so close and would like just some peace of mind :(

If you apply to PR you certainly can, however when you do so through the Federal stream (express entry) you must satisfy that you intend to settle anywhere but Quebec, otherwise you should apply through that province.

Having said so, I do not see any reason why not to apply. The fact that you have decided to stay in BC clearly supports this and you should be fine. Once you get your PR you can easily settle in QC.

But isn't in the EE application any declaration of my and my husband residence address ?
It would be a problem if our address will be different ?
And, are we elibigle to apply together from BC even if one of us in not in BC ?

I'm just afraid that one of the condition in order to apply from BC is to be in BC at the moment of the application, but I don't know if this is true only for the main applicant, or it has to be true for the husband as well....

can you help me with this ?

He can get an open work permit based on you PGWP right now if he can demostrate you have been living together for at least 1 year (bring as many documents as you can to proof you relationship) or if you get merried he will just need a copy of you marriage certificate.
as far as i know no gap required, I came to canada 1 week after my marriage and my husband came after 1 month because of work.
There is nothing bad to say you got married in order to continue your relatioship in canada as far as it's the true, I would still bring some paperwork to proof your relationship just in case.

You need a skilled job and 3 payslips in order for your spouse to apply for an OWP based on your PGWP.

The fact that you are currently living separately does should not be an issue. Remember that you are always able to add an statement along with your application to provide any additional information. When you apply through a Federal Stream you can do it from anywhere in or out of Canada. Unless what you mean is that you are applying to a provincial nomination, which in some cases they do require you to be physically present in the Province at the time of application. If that is the case that might be different depending on who is the main applicant.

But so far I don't see any issues.

I AM GOING IN APRIL 2019 AND WE WILL DO A COURT MARRIAGE AND THEN I WILL COME BACK AND APPLY FOR HIS WORK PERMIT.
I HAVE ALSO COMPLETED MY ONE YEAR AND NOW I WANT TO APPLY FOR MY PR. WHAT OPTION SHOULD I GO WITH PLEASE SUGGEST

1) I APPLY FOR HIS WORK PERMIT AND THEN WAIT TILL HE GETS THE WORK PERMIT AND COMES HERE AND WE BOTH CAN APPLY FOR PR TOGETHER?

2) I APPLY FOR HIS WORK PERMIT COME BACK AND APPLY FOR JUST MY PR FILE AND ONCE HE COME BACK I CAN ADD HIM

3) I APPLY FOR HIS WORK PERMIT COME BACK AND APPLY FOR PR FILE FOR BOTH OF US .
