Apply for TRV in NYC due to dwai violation?

Hello.

Finding information on this whole process has been so difficult so I am especially grateful to have found this forum. Please have patience with me.

I, unfortunately, have a DWAI in NY. This is not a criminal offense, but a traffic violation for having a blood alcohol concentration (BAC) of .05 to .07 while driving, not over the legal limit, but NY deems it a factor in my poor driving choices since I was pulled over for speeding & had some alcohol still in my system. All of the immigration/dwi/dui attorneys who advertise online say this will affect me as well even though my dwai is a traffic violation, and I have not been convicted of any crime- no criminal record.

I don't want to take any chances so I am applying for a TRV for our upcoming Alaskan cruise that ends in Vancouver.

Since I live and work in NYC does anyone know if I can apply for the TRV in person at the NYC consulate or do I have to do everything via mail? Our cruise is in Aug 2024 and my in-laws planned it for the entire family for Christmas. We just realized my dwai may affect this so now I feel under the gun to hopefully get the TRV so that I can join my family on this big trip. If it were up to me, I wouldn't have committed to the cruise before I had approval to enter, but here we are.

Your DUI even though a traffic violation in the US, is a criminal offense in Canada under the Criminal Code. This would make you inadmissible to Canada. Are you a US citizen? If you are, you can’t apply for a TRV. You cannot apply in person.

Thank you for your reply. Yes, I am a us citizen. Since writing this post I contacted the nyc consulate & they emailed me the paperwork & checklist on how to apply for a trv as a us citizen. Processing time is 26 days currently.

Thank you for your reply. Yes, I am a us citizen. Since writing this post I contacted the nyc consulate & they emailed me the paperwork & checklist on how to apply for a trv as a us citizen. Processing time is 26 days currently.

You are applying for a TRP and not a TRV

You can apply for a TRP at the border

You can only apply for a TRV by mail / online.
