apply for open work permit

hi there everyone, just wanna ask if i can apply for open work permit since I'm married to Canadian citizen. Im a foreign worker and I'm now on my restoration period. My previous employer did not renew our contract and i found a employer who's wants to hire me and LMO is already on process. The employer faxed it last july 24 and still waiting for positive LMO. He told me to just apply for work permit without lmo as long as we have the file number. So i sent my application and hoping to get a positive lmo and a new work permit. My work permit expired last may 31, 2012 and I'm almost over with the 90days grace period and getting worried already.My other question is what if the lmo denied whats gonna happen to me are they gonna sent me home. I don't wanna leave my husband thats why I'm thinking if i can apply for open work permit and later on i will apply for permanent resident(suppose sponsorship) as soon as i have a new work permit.

Pls need some advice from u guys....

No - unfortunately you do not qualify to apply for an open work permit by being married to a Canadian.

If you are married to a Canadian citizen.... why are you waiting to apply for PR? When did you get married?

If your employer does not get an LMO, or it comes too late, your Work Permit will be automatically refused. Which is very serious.

Where in Canada are you and your husband living now?

i just got married last may. and were here in edmonton alberta rytnow. i haven't submitted my PR application coz I'm still gathering all the requirements like NBI from Philippines, police clearance and everything. And I think i have to have legal status before submitting my application which is i don't have it rytnow my work permit expired.
