Apply for CEC PR while Out of Status

Please see below for my case. Help would be much appreciated.

I applied for a restoration of status prior to the 90 day deadline (Jan 14, 2016) after going out of status. I received an invitation to apply for PR under CEC on Jan 27, 2016 and applied on Feb 8, 2016. I applied while out of status but restoration app under process.

My question is that everything I have done is OK? Or could I not have applied? Please advise.

Also, Can I leave the country now if I have to while the 2 apps are in process. Also, if I do, how do I notify CIC?

No, you cannot leave the country while you have applied for restoration. I am also under restoration right now and was advised to remain in Canada. Why is that so? Because once you have left the country your application for this visa is invalid and will be refused since you obviously won't need it anymore. Also, you may not be able to re-enter Canada without this visa and the time you spent prior to receiving it, they may consider as being in Canada "without status", which is more or less illegal. Furthermore, I think, the visa will be sent to your home address / mailing address in Canada. So you won't be able to pick it up, if you are denied re-entry.

All the waiting is terrifying, but that's what we need to do.

Thank God, status got restored!!

But still not sure how PR would get affected as I didn't have any status when I submitted my application. Should I submit my new Temporary Resident document via Case Specific Enquiry for my existing PR application to let them know that my status has been restored?

Is this restoration of status as a visitor? I thought, they were working on November applicants according to their website. This went fast. Great!

Yeah that was very fast, I applied for restoration of status in January and was told they working on November applicants.

Did you apply to restore as a visitor?

Yes, visitor.

I am surprised too because they are working on Nov 7 applicants right now. I have a feeling that my status was restored quickly due to my PR application. That file is open and CIC requested additional docs (Schedule A) from me where I had clearly mentioned that I am currently out os status. So they may have reviewed this application (ROS) before they can proceed with my PR application. But not sure. Happy that at least status got restored, hopefully PR comes soon as well.

Oh okay. I have also applied for PR but through ontario provincial nominee but they have not yet sent me an AOR yet. So it hasn't reached federal yet to be processed.

Oh well , fingers crossed for everyone . I do hope your PR comes soon.

I have found myself in the same situation as you. I have applied for PR after my PGWP expired. I made sure to apply for a restoration of status to visitor and included this in my letter of application for the PR application.

I would like to know if this affected you getting your PR.
