Me and my family plans to seek Asylum @ US-Canada borders as I am currently persecuted @ my home country. My wife has its aunt in Canada.

however, my wife's aunt could not be in the country (Canada) when we plan to arrive at borders.

My wife's aunt has her son in Canada.

We have copies of her passport and Birth Certificate.

What are the arrangements in this case? can we come even my wife's aunt will be out of the country?

If you do not have an answer can you guide me whom to ask?

The aunt must be IN Canada at the time of the claim.

The aunt's son is not a family member for refugee purposes and is therefore irrelevant.

Thanks zardoz. I understand that they say:

"Family member exceptions
Refugee claimants may qualify under this category of exceptions if they have a family member in Canada who:

is a Canadian citizen;
..........................."

but I believe "In Canada" does not certainly mean physical presence rather it means you have a family member who is Canadian.

I have read from vive website the following:-

What evidence do I need?

An immigration officer will interview you and take into account what you say. However, it is important to bring as much documentary evidence as you can obtain. It is essential that as many documents as possible, especially your documents, be originals. However, copies are acceptable if the originals are held by United States immigration authorities. The documents that you should bring include:

For You and Each Family Member with You:-

  • Birth certificate and
    Passport or
    Driver’s license, national identity card or other photo ID documentation from your native country.

    For Your Anchor Relative:-
    • Birth certificate and
      Birth certificates to prove relationship and
      Evidence of status in Canada

      So if I have all family member docs proofing relationship I guess it can work.

      I heard that in some cases they ask to call the family member. and I can provide them with her telephone number.

      What do you think?

You need to read the link that I posted.

A claimant arriving from the U.S.A. qualifies for an exception and will not be returned to the U.S.A. if they have:

A family member who is a Canadian citizen or a permanent resident under the Act and who is in Canada at the time the claim is made
Why would you assume that "who is in Canada at the time the claim is made" means anything other than physical presence? If it wasn't relevant, it would not be explicitly stated...

I agreed with zardoz - the family member must be physically in Canada at the time the claim is made in order to qualify for the exemption under the Third Country Agreement.

i also think that the term "in-canada" refers to be physically living in canada.

Best wud be to contact the RPU and ask them. they will be happy to answer you and give you the exact information. i personally had many confusions before claiming protection at US-Canadian border and VIVA was also not providing me satisfactory answers. so what i did was i directly phoned the RPU (refugee processing unit) at peace bridge and they were very helpful and they answer all my question and they make sure that i had all documents before i come to them to make the claim. the officer i was talking to even suggested and encouraged me that i can directly schedule my appointment right now on phone or whenever i complete my documents and i do not even needed viva's help.

So best advice wud be to directly contact RPU and discuss your concerns/questions with them.

- Yes if your relative cannot come to the boarder in-person then they will call your relative and interview/verify your identity and relationship through phone. (in my case my bro was unable to come to the boarder so they call him to verify all things and i was good togo)

I do not have the number right now in hand and it was difficult for me to find the number as well. i called at different numbers of CBSA and boarder information to got their number.

It is (RPU)refugee processing unit located at buffalo ( cbsa plaza fort Erie, peace bridge, on) it is also called refugee reception center located at peace bridge, fort Erie.


The Refugee Protection Division (RPD) is something else and is the division of the Immigration and Refugee Board of Canada (IRB) that hears claims for refugee protection made in Canada and decides whether to accept them. So you will be dealing with rpd after you come in Canada or in simple terms the judge who will hear your case is the Rpd/irb guy.

So basically you are looking for RPU contact number or the contact number of cbsa office present at Canadian-us border, peace bridge fort Erie
