Hello,

I'm wondering if I have it right for how we are applying!?

1. My boyfriend will be in Canada on a temporary work permit. (Valid May-October)
2. We submit our INLAND application along with a request for an OPEN WORK PERMIT. (in May)
3. What next? How long will the open work permit take and what do we do if the temporary work permit expires in the meantime?

Thanks for any advice or insight!!

As far as I know a person doesn't apply for the open work permit until you receive confirmation that you have been approved as a sponsor - which is usually 6months from the time you apply with an in-canada application.

You include the request for the open work permit with the application to Vegreville, if you get Approval in Principle, a work permit would be issued AIP takes about 5/6 months.

You can send the application for open work permit (use the change of status form) with the sponsorship documents and just write in the comments section that you request the open work permit upon first stage approval. It's a little bit faster than to wait for the first stage approval and then apply for the open work permit.

If his temporary permit expires in the meantime and he can't extend it, then he can apply to change his status to visitor while he waits.

I'm also a temporary worker and my PR application, together with the OWP app, is already in process. My temporary work permit will expire in January so I phoned CIC and they told me that I can still work for the SAME employer even after my TWP expires since I already submitted my application for an OWP. No need to apply for an extension or change status to visitor while waiting. As long as the OWP app is already submitted and it's the SAME employer and not a new/different one, there won't be a problem. "Implied Status" was what she called it.

I did not know that implied status applies in this case, but if it does, you are good.

Thank-you for everyone's helpful advice.

Considering the AIP will take 5-6 months would it make just as much sense to apply OUTLAND while he is working in Canada on a temporary work permit? His work permit cannot be extended past October with the same company because it is a seasonal operation that does not employ people over the winter.

If he does OUTLAND we would be applying through Buenos Aires. I know OUTLAND is generally faster but we'd would like to stay in Canada and both be working over the winter (we will submit application in May). Is INLAND going to be the safest option?

It "usually" takes as much time to get the OWP with an inland application as it does to get PR with an outland application...

OK thanks for that, then this hopefully my final question!

If we apply OUTLAND and he is IN Canada on a Temporary Work Permit and that permit expires, can we have his status changed to TRV so that we can stay in Canada while waiting for the PR?
