Apply for a BOWP without the AOR

Hey Guys,

My CEC application package was received by the CIO-Sydney on October 03 but I haven't received the AOR so far. I know for sure that the certified check has been cashed in December (I presume that this is a good sign), although BMO did not confirm the exact date.

My current OWP is due to expire by the end of this month (January, 2015) and I am afraid that I won't be able to apply for a BOWP if I don't act right now. I've read some reports[1] on this forum from people who were able to get their BOWP approved without the AOR.

I've also found the following FAQ on "Moving 2 Canada"[2]:

"I’ve applied for Permanent Residence under the Canadian Experience Class. I haven’t received my AOR yet but my work permit expires in three weeks. What should I do?

Many people find themselves in this situation. They are waiting for their AOR (which takes about 60 days to receive after filing) but their work permit is set to expire before they will receive it. You are still eligible to apply and should do so a few days before your work permit is set to expire. Here’s why:

When Canadian visa officers are assessing your application, they will either look for an AOR, which is included in the application, or they will check the Global Case Management System (GCMS) to see if the “Eligibility CEC” decision has been set to “Passed”. If in between the time you applied and the day the officer will assess your application (if applying on paper, this will take about 50 days or so) you will have received your AOR. Internally, when you receive your AOR, your eligibility status has been set to “Passed”. For the time between when you applied for your Briding Open Work Permit and the time you receive it, you will be on “Implied Status” as per S. 185(5)(a) of the Immigration and Refugee Protection Regulations."

Based on these resources, I believe that I should give it a try, however I would like to hear the opinion/ask a few questions to those who are/had been on the same situation.

1) The "Find out if you're eligible to apply" wizard only shows "Open Work Permit" as an application option when you answer "Yes" to the question which asks about the AOR. Should I answer "Yes" in spite of not having received the AOR? If I answer "no", "Open Work Permit" does not show as an option.

Has anyone faced the same situation before?

I really appreciate any help.
Thank you!

P.S.: I had to remove all my references ([1] and [2]) because I am not allowed to post links. I apologize for that.

I am also in similar situation. However I will be applying through paper work on 27th Jan.
FYI. I am an Oct applicant still CC not charged. You are in better position than me. Proceed without AOR and add covering letter for not including it.

No need for disclosing with the employer. You can renewal SIN only after getting your hard copy of work permit.
your SIN will be expired as soon as your work permit expires.

Well, your employer should be aware that your work permit is expiring. If they ask and need an explanation about implied status, you can give this information on the CIC website -
http://www.cic.gc.ca/english/resources/tools/temp/visa/validity/implied.asp

Note that you cannot leave Canada while on implied status, or else you will lose implied status.

exactly.
i was looking on the internet and you just need to inform your employer about this 'implied status' and explain it to him. for sin renewal you can apply when you will get hard copy of new WP.

I have other question...they need to get my application for new WP before my current WP expire or the date of sending a letter is important and I just to send it before my WP expire?!

Hi,
the date of sending your letter is important. That's why it's better to use a courier in order to prove your date of sending. Personally though I would send the letter a week before the WP expiration just to be sure the letter will be delivered before the WP expires. Better to be sure than sorry.

I had to do the same thing back in December.

WP expired December 2nd

Applied for BOWP December 1st

My timing is actually a little worse, because according to the October Applicants thread, the processing time is so long right now that my AOR won't be issued before March... in that case it looks like I'm a goner.

If you have until February then don't sweat it too much. Apply for the BOWP via MAIL, not online. It will take them at least 6-8 weeks to even look at the application, and by that time your AOR will be in the system.

Hello Guys,

I just want to thank everybody for their replies. I ended up applying online and thankfully my BOWP was approved.

This is my timeline:
Jan 12 - Applied online for a BOWP
Feb 10 - Received AOR
Feb 26 - BOWP app was approved

Hope this helps those who are in a similar situation.
