Firstly, let me extend my appreciation to all fellow members for sharing their experience / advise / timeline with fellow members. This forum is a great initiative to exchange views and discuss individual cases. I discovered this forum few days back and was pleasantly surprised & impressed by the number of replies / views of all members to everyone's cases. I thank you all for being so co-operative and sharing your thoughts.
Let me share my experience/timeline on the rocky, rickety road to PR Approval so far!
Medical done (at New York), PCC (New York and Delhi) - April 2009 (Lived in New York City from June 2005 to May 2009)
Application Mailed, CPC(M) - June 19 2009
Application Received - June 22 2009
Sponsorship Approval - July 22 2009
CHC-Delhi begins application processing - August 6 2009
Additional Docs requested - October, Nov 2009
Application Rejected - January 20 2010
Rejection Letter Received - January 28 2010
Case overview : Me and my wife (a Canadian) moved to Delhi in May 2009 from New York after getting married in March 2009 at Mississauga, ON. We decided to move to Delhi temporarily till the PR process gets completed and decided to settle down in Toronto thereafter. The additional doc letter received by CHC, Delhi in Oct., Nov. 2009 asked for our re-establishment plans - Job letter/apt. bought or leased/etc. We exchanged letters but they eventually rejected our application stating that they are convinced that the Sponsor, my wife would not go back/reside in Canada if PR is granted to me. Hence, after our case got rejected, my wife had no choice but to go back to Canada alone. She flew on Jan 28 2010, the day we received the rejection letter. In the interim, she got a job and an apt. on lease. Clearly, it was completely our fault as she should've left when they asked for our re-establishment plans and should not have stayed in India for so long, especially after applying! Also, they neither questioned our marriage/relationship nor called us for an interview. I believe the only problem was that my wife was with me in India during the entire course of application processing! We even emailed them her boarding pass and ticket confirming her arrival in Canada but in vain. Our intentions were to travel together after PR approval, thats all! Anyway, no point crying over spilt milk now!
We were advised by friends and our Immigration Consultant to request for a refund and re-apply. The refund amount is CAD$ 490, which would confirm the file has been officially closed. It took a little over 3 months to finally receive the check. I found this absurd but did not want to question/argue with the authorities out of fear considering what we had gone through so far. Appealing was not recommended in our case as I believe it is a long, expensive and painful process.
Applied for Delhi PCC again - Feb 4 2010
Medical, again - April 14 2010 (at New Delhi)
Received refund for withdrawing previous application - May 10 2010
Applied again, CPC-M - May 12 2010
Application received by CPC-M - May 13 2010
Sponsorship application Approval - June 18 2010 (Status - Decision Made)
eCAS updated for first time - June 22 2010
Sponsorship Approval letter received by wife in Canada - June 23 2010
File sent to Delhi. Now, waiting.......................
Quick Question: I did not apply for New York state clearance/FBI clearance again as the originals were submitted in our previous application and I did not go to the US again after my return in May '09.
Although, I have attached xerox copies of those police clearances (FBI and NY state) from my previous application in the current application, (Thank GOD I had xerox copies of those!)
Would those still be valied?
To be on the safer side, I just got my Delhi Police Clearance Certificate (as of June 2010). It takes about one month for issuance of Delhi PCC. I did not want to waste more time and have it ready in case it is required again as the previous one is old now.
Should I go ahead and apply for US clearances as well. Just in case???? I would have to get fingerprinting done here in Delhi and would have to send a request to US authorities by mail. I guess it would take about 2 months to receive clearances by mail.
Hoping, there won't be a hurdle and the application approval process goes smooth, steady & quick this time! Cz' it has already been so painful & frustrating till now!
Thoughts / Advise/ Views / comments / suggestions would be much appreciated. My apology for sounding paranoid! =)
