Hi there,

I have applied on August 2.007 but got the request for document on March 2.009, I was wondering under which rules my case will be considerate. I mean, my IELTS date is March 30, 2.009 and according by what I have read in this forum it will be assessed under new rules, but what about Factor 3?, experience, which NOC list would be considerate, the new one or the one that ruled when my application was submitted?. Can you help here? I just want to know how many points would be awarded in this factor if new rules affect me.

Thanks in advance!

You will be assessed according to the rules that were in place @ the time of the application-in this case old rules.

According to the new rules, if it is going to be to your advantage.
but what about Factor 3?

,experience, which NOC list would be considerate, the new one or the one that ruled when my application was submitted?. Can you help here? I just want to know how many points would be awarded in this factor if new rules affect me.
Old Rules- Rules that were in place at the time the application was submitted.

Thanks in advance!
Man, you guy's should do some research on the CIC web-site. Where do you think we all get our information from. We are no Immigration Consultants nor Lawyers.

Here see for yourself:

Thank you BobbyB, that's the spirit that we are looking for when we have a question and by the way It may sounds stupid to you but according with some posts in this forum new law can affect my IELTS becouse its date is after February 27, 2008, although my application is before that date, so It makes sence to ask to people that knows the subject think about that, and yes I already did my research and there are more variable to considerate than "If you applied before February 27, 2008, your application is not affected by the new law. It only applies to applications submitted on or after February 27, 2008".

I really thank David Cohen and his people about this forum it is a great source for sharing knowledge but when you find this kind of answer people might thing that posting a question does not worth it.

I am sorry to bother you, my question still no have an answer.

fair enough, Can you be specific? What part of the answer don't you understand or feel unanswered?

If it is the IELTS part, I have already answered it. If you don't understand it and want me to elaborate on it (which I can), say so.

Note: Visa officers should also assess applications and test reports which pre-date November 28, 2008,
against the above correlation table if it is to the applicants advantage, i.e., resulting in more points
for language proficiency.
