ND VO is still giving the same reply of 120 days, whereas in my query I clearly mentioned that I am a post 26 June applicants and rules have changed after 26 June 2010. We have sent all the documents to CIO, NS.

Can someone help with CIO mail ID so that I may send a question to CIO and clarify this before we cross 120 days time line.....

Dear Sir/Madam,

This is in response to your recent email enquiry to the Immigration Section of the Canadian High Commission in New Delhi.

This refers to your application for permanent residence which was received in our office in Sydney on xx-x7-2010.

On 23-11-2010, we requested you to provide the following documents as per the attached letter. This letter was sent to your current mailing address on file via regular post or by email to the address you provided on your application form. The letter also provided you with 120 days to make your submission.

To date we have not received the requested information. We cannot continue processing your application without this information.

Please quote our complete file number on all correspondence with our office and address. The requested documents should be sent in a SINGLE package by mail or courier to the Canadian High Commission:

Canadian High Commission
Immigration Section
PO Box 5209
7/8 Shantipath, Chanakyapuri
New Delhi, India 110021

You have been provided 120 days to submit these documents at which time a decision will be taken on your file. Failure to comply with this request may result in your case being refused.

We trust that the above information is of assistance.

Immigration Section

Dear Madam/Sir,

We have received your application for permanent residence in Canada in the Federal Skilled Worker Class.

We have assessed your declared occupations against the list of eligible occupations identified by the Minister of Citizenship, Immigration and Multiculturalism and published in the Canada Gazette on 28 November 2008. Your application is being recommended for further assessment by a visa office. You are therefore requested to submit a full application to the following visa office:

The Canadian High Commission
Immigration Section
P.O. Box 5209
7/8 Shantipath
Chanakyapuri
New Delhi, India 110 021

Please note that your file has already been transferred to the above visa office. Any future correspondence will be with that visa office. Your reference number is located in the top right hand corner of this letter. You must quote this reference number in any future correspondence. A receipt for the application fees submitted is also enclosed. If you submitted original supporting documents, these are being returned to you and are enclosed as you may be required to submit these with your full application.

Submitting your Full Application

Go to http://www.cic.gc.ca/english/information/applications/skilled.asp to download the Federal Skilled Worker guide and application forms.

Your full application must consist of the following:
- A copy of this letter with the reference number above
- Application for Permanent Residence in Canada [IMM 0008]
- Schedule 1: Background/Declaration [IMM 0008 SCHEDULE 1]
- Additional Family Information [IMM 5406]
- Use of a Representative [IMM 5476] (if applicable)
- Schedule 3: Economic Classes [IMM 0008 SCHEDULE 3]
- Visa office-specific forms available at: www.india.gc.ca or http://www.cic.gc.ca/english/pdf/kits/guides/E37029.pdf.
- All supporting documents (see document checklist for the visa office to which you are applying)

NOTE: You must inform the visa office of any changes in your application (e.g. birth of a child, marriage, new occupation or employer, etc) when submitting your full application. Please include a letter identifying what the changes are.

You have 120 days from the date of this letter to prepare and submit these forms and supporting documentation. If your full application is not received within this time, we will assume you are no longer interested in immigrating to Canada and we will close your file. Documents must be submitted in a SINGLE package. Do not submit any documents until you have prepared the entire package. We will make a decision on your application on the basis of the documents you provide at that time.

Until we have received your completed application, we will not accept, respond to, or attach to your file any interim correspondence, EXCEPT:

1 Change of address, including change of e-mail address;
2 Change of immigration representative;
3 Request for withdrawal of your application and refund of fees;
4 Submission of an Arranged Employment Opinion approved by Human Resources and Skills Development Canada

Once the visa office has received your full application, it will send you an acknowledgement of receipt letter which will inform you of the visa office's processing times and the next steps in the processing of your application.

Prepare yourself for immigration to Canada

Although your application is being recommended for further assessment, please note there is no guarantee that your application will be approved. Do not dispose of any property or assets until your visa has been issued. However, we strongly recommend that during the time your application is being processed you should prepare yourself for your possible immigration to Canada. You should learn about living and working in Canada so you can decide where to live and prepare yourself and your family for life in Canada.

Languages

Canada has two official languages, English and French. Depending on where you want to live in Canada, you will need excellent speaking, reading and writing skills in one of these languages. If you do not have strong English or French skills, study the language before going to Canada and learn the vocabulary of your profession or trade. Remember: you will be competing against native speakers of English and French for any available jobs.

Work

Finding work is a challenging process for Canadians and for immigrants. It is essential that you prepare to work in Canada before you move. Even if you have many years of work experience in your home country, you may not be able to work in your trade or profession in Canada. There are many things you can do in your home country to prepare for working in Canada and make your job search easier.

One of your first steps should be to begin researching potential employment in Canada. Most occupations in Canada are not regulated which means that for those occupations, the employer is responsible for assessing and recognizing your qualifications.

However, some occupations are regulated and do not permit persons to practice without a license. To obtain a license to practice a regulated occupation, you must go through an assessment and an acceptance of your education and professional qualifications by a regulatory body. This assessment will compare your training, education and experience to Canadian requirements. The assessment will also help determine whether further training and evaluation may be needed before you acquire a license to practice your occupation in Canada.

In partnership with Service Canada, the Foreign Credentials Referral Office (FCRO) provides information and referrals. You can find more information on the FCRO Web site at: www.credentials.gc.ca. Clients in Canada can call 1-888-854-1805 or the Service Canada general enquiries number at 1-800-O-Canada (1-800-622-6232) for more information. Clients in Canada can also obtain in-person service at Service Canada Centers.

The Going to Canada Internet site (at www.directioncanada.gc.ca) contains important information about living and working in Canada as well as the “Working in Canada Tool” which will tell you what the current prospects are for your occupation across Canada. It offers information on essential skills, job descriptions, work conditions and opportunities. It will also tell you whether your occupation is a regulated profession in Canada.

Thank you for your interest in Canada.

We trust that this information will be of assistance.

How can we make ND VO in sync with post 26 June rule, they are just sending replies based on of Canada Gazette on 28 November 2008, where as our PER clearly says that we are Canada Gazette on 26 June 2010
Is there any way to actually telephone the visa office and speak to someone? Or is email / letter the only way to contact them?

The fundamental problem is that your application is being processed under the wrong rules, and that's what needs to be addressed. Since emailing them doesn't have any impact I wonder if there is any channel for telephoning them and speaking to real person about it?

Hello Everyone,

I just got a confirmation from my bank that the my BD is still outstanding as of this writing. I'm beginning to worry about this co'z it has been almost 4 months since I sent my application but up to this time the BD is still outstanding & I haven't receive any feedback from the CIO. Would somebody know whta are the possible scenario that happened to my applications? Was it rejected or will there be a chance that I'll be getting a NER for this? I looked into the spreadsheet & almost all of the BD for sept applicants were already encashed.

Thanks.

Hi Annjay,

I am also sept'23 applicant and waiting for PER. When i asked my bank to inquire about whether DD en-cashed or not then they said it may take 7-10 working days to know it (with charge of 250/-:)). I believe, lets wait for 1week more and then we can send direct email to CIO. At this point we only can do is waiting.

Hope for the best.

Thanks for keeping my spirit up. I'm about to send an email to the CIO using this link http://www.cic.gc.ca/english/information/offices/canada/csu.asp but as you've said let us wait for one more week. At least on your case the bank didn't confirm regarding the status of your DD. Well, I'll just hope the information given by the bank to me is not updated just ease up the negative feelings I have.

It is evident that VO offices that are constantly barraged by applicants usually turn out to be very uncooperative. Maybe ND applicants should desist from contacting them and wait till they are contacted as clearly expressed by the VO.

I think always+ve's circumstances are genuine and he is not just someone trying to unnecessarily pester visa office for an update on his status.

It is visa office who have made the error in assessing his application under the wrong rules (Nov 2008 rules instead of June 2010 rules). If he waits until he is contacted in this instance then it will be a rejection for failing to provide documents within 120 days. Even though this error is clearly the visa office's and not his it could take months and months to get himself placed back into processing if he is not able to clear up this mistake with them before the 120 days expire.

Since contacting them by email/online does not seem to have gotten through to them that they have made a big mistake, I am wondering is it possible to either telephone them or go to the visa office in person to try to sort it out?

Wayne.

Have your bank told you that it hasn't been cashed? Or are you unable to find out?

If it's the former then it might be worth contacting CIO since not cashing after 6 weeks is unusual. If it's the latter tbh I would wait it out rather than hassling CIO with it.

I have not received any letter from VO or any new file number.

The VO replied the (mentioned content) after I posted my query on the status of my application, considering me as 2008 rule not 26 June 2010 rule.

I have replied VO mentioning the error, let us see what and when they reply.

Hey Vicky1,

Congrats for the PER!!!!!! the office hours at CIO NS is 8.00am to 4.00pm and IST is 10.5 hours ahead so the the time is right

You can confirm this by email them back about the misspell, but I am not sure about their reply on this because I have not heard or read this kind of mistake from CIO and any forum member quoted this in the thread, but try to contact them about this mistake.

Good Luck!!!!
