Application Transfer to India

Dear all, I know that transferring application from one visa center to the other will take couple months delay. My question is, has anybody done that? I hind-sighted the fact that my visa is getting expired and there is no way I would get a decision if at all I am approved by CIO, before my visa expiry, through Buffalo. So, I would like to transfer my application to New Delhi, India. Has anybody done this before? And how long did that take for New Delhi to reflect in your status? Your experience and opinions are highly appreciated.

You need to send an application to Buffalo regarding the same. It will take at least 3-4 months to get the application transferred. If you are lucky, it can happen in 2-3 months as well. You need to explain your reasons for doing the same.

Hello canpr - Will appreciate knowing what action did you take as I am going to be in the same situation. Have you succeeded in having your file transferred to New Delhi.

I am also in the same situation in fact mine is going to expire soon...!!! Not sure I should stay here out of status or move back to India...not sure staying out of status in another country have any adverse impact... So thinking of moving back soon...stayed here thinking Buffalo will get faster...

You may wish to read CIC/CHC take on transferring files.

"offices are not required to transfer files for any other reasons. Such reasons include cases of applicants who comply with subsection R11(1) for the specified visa office, at the time the application is received at the CIO, but subsequently leave the territory of the specified visa office. In these cases, the original visa office should proceed with a final determination of eligibility and process the application if eligible. The visa office should not transfer the file to another visa office unless the transfer is warranted for program integrity reasons. Leaving a visa office’s territory alone does not warrant a file transfer. In this case, if an applicant requests a file transfer, the visa office should inform them that the application will not be transferred and that they are required to submit a complete application to the visa office originally specified within the 120 day deadline allotted by the CIO."

what you guys think after PMM's post. Should we tranfer file or leave it as it is at Buffalo and move to India or stay here untill decision is made.

Hello kk007,

As per the link provided by PMM, the file can not be transferred. So, its for us to decide whether to stay in Canada (legally) or return to India and pursue our case from here. We may have to travel to Buffalo for the interview (if required) and to have the passport stamped with PR when process is completed.

I m currently residing in New Jersey, I m planning to send my initial application to NS, If my project ends I may need to go back to india. I see lot of waiting time for second stage in Buffalo than New delhi. I understand the transfer of file is not possible.

1. Can I apply from here and mention the VISA OFFICE as New Delhi ?
2. If I stay back here in NJ, will my application cause any issues or only interview I need to attend in delhi ?

please advise.
