Just realized i didnt answer the first question.

If you are found ineligible to sponsor, indicate wether you want:

A- to withdraw your sponsorship. All processing fees less $75 will be repaid.
B- To proceed with the application for permanent residence.

anyone want to tell me the obvious im missing here? ;D

IF YOU ARE FOUND INELIGIBLE...... TICK A


YOU CANT SPONSOR IF YOUR FOUND INELIGIBLE...SO IF THEY SEND IT ABROAD ITLL CAUSE PROBLEM

What they say in the guide is that if you chose to have the application sent back if you are ineligible to sponsor then you CAN NOT APPEAL. However, if you tick the box to continue with the application if you are found ineligible to sponsor the YOU CAN appeal the decision. So, in other words, if you are 100% positive that you meet all the requirements to sponsor and there is no reason they should refuse you, then check the "continue with application" box. If you are unsure, check the "return application and fees" one.

i'm also confused by this question, anyone offer advise here please?
my wife has filled in the forms to sponsor me, she has ticked all the boxes so SHOULD be approved as sponsor, so which option do i choose??

Always tick 'A'. If you are not able to sponsor, but tick 'B', the application will go to the visa office, will spend a lot of time in processing, and will definitely be refused. Yes, you can then appeal, but waiting for an appeal date takes another year or two, and you will probably lose the appeal anyway - because your sponsor is not eligible.

If you tick 'A', the application will be returned to you - quickly, after the 45 days or so of processing in Mississauga. You can then look at why the sponsor was rejected, and correct the problem. It might have just been a simple mistake in filling out the forms; it might have been something more serious, like that you were on welfare. In any case, you can take whatever steps you need to fix the situation, then reapply. This time, also tick 'A', but probably this time you will be accepted as a sponosr and the application will be sent to the visa office for processing.

If the application is refused at the visa office, you still have the right to appeal. The right of appeal you lose by ticking 'A' is the right to appeal the sponosrship refusal. If you tick 'A', are accepted as a sponsor, the sponsorship is sent to the visa office and processed, and the VO decideds to not issue the PR visa, you still have the right to appeal this decision.

The only reason to tick 'B' is a case where you know the sponosr is not eligible, but you are hoping to win an eventual appeal on compassionate and humanitarian grounds. This is not easy in any case, and will take a long time.
