Hi ???

My NOC is 1221 (Records Analyst) which won't be able to apply PR anymore under new CEC rules( effective from Nov. 09.) I sent application on Nov 08 but I found that my application is still in transit. It might be delivered by Nov, 11. also the application is not completed so I have to send more documents as soon as its ready.

The stamp date on the package is Nov 08 so what rules will be applied to me? new CEC rules or old one? I hope I still fine with my NOC..

Unfortunately anything from Nov 09th 2013, will fall under new rule.

what about an updated credit card info??
 
The date you sent your application does not count, what's important is the day CIC received your application.
So your applicationa will be assessed according to the new MI-10 and therefore as your NOC is not eligible anymore, sent back.

Making the final determination of eligibility for processing at the Centralized Intake Office
The CIO will assess the CEC application received on or after November 9, 2013, and will make a final determination of eligibility for processing. To be eligible for processing, the application must be complete and meet all the criteria described in the MIs.

Work experience in the six ineligible occupations set out above cannot be used to qualify for processing. In order to be placed into processing, the applicant must have claimed at least 12 months of work experience in one or more eligible NOC Skill Type 0, Skill Level A or B occupations. In assessing the applicant’s claimed work experience, the CIO will review the information provided by the applicant in the Schedule 8: Economic Classes – Canadian Experience Class (IMM 0008 – Schedule 8) (PDF, 1.3 MB) form submitted with their application. The conformity of the work experience claimed by the applicant to the corresponding NOC description will not be assessed by the CIO. This assessment will be made by an officer once the application has been placed into processing.

Only CEC applications received by the CIO on or after November 9, 2013, that include original, valid test results from a language testing organization designated pursuant to R74(3) demonstrating that the applicant meets the language threshold set by the Minister for each language skill area (reading, writing, listening and speaking), that do not exceed the caps set out above and are not claiming work experience only in one or more of the six ineligible occupations listed above in support of their application, shall be placed into processing.

How can he be eligible if his application will be received after Nov-9th with a NOC not eligible under the new rules?
 
I am saying there may be a chances.
if not they will return back the Application without charging any amount.

Don't give false hopes, if it arrived at CIO Sydney after Nov.8th in an ineligible NOC, it is coming back.

No, if the application is received after Nov-9th there's NO chance, the application will be send back.

I did not say they will cosider it.
 
I processed my CEC application fees online on Oct 30, 2013. Since, the facility of paying the fees for CEC application ONLINE was available and then I submitted my documents on Nov 04, 2013 which reached CIO Sydney on Nov 08, 2013. Now, that they revised the eligibility for applying under CEC category now they removed the option of paying application fees online.

So, What should I DO now ??

If you've already paid, then that's fine. And if your application was received before Nov-9th, then it will be assessed under
the old rules.

Ok, it's as easy as that: There's no chance. And that's how easy we should try to keep it for users.
