Application Returned, Help me Understand!

Alright I want to start off by thanking this community as it has provided me plenty of valuable information...
This is a Family Class Spousal USA outland application. I am the canadian and my wife is the American.

So we mailed beginning of july and it has come back to us with a form only one thing highlighted....

So we put my Canadian address as mailing address and it seems they want/need a use of a representative form filled out stating its ok to release documents to me there I guess?
It totally never even crossed my mind i'd need that silly representative form for it to be ok to send correspondence to ones husbands address.. haha annnd it also clearly states if you include an e-mail everything will be conducted via that. and we have indicated an e-mail so shouldn't that almost negate the mailing address purpose anyway?

I origionally thought maybe it was the conflict of address between her travel documents being different than her residential address. Do you guys think this may cause confusion and issues as well? we just haven't bothered changing it all over since she moved from her last place and she spends nearly all her time "visiting" here... Will they grief us over her current address not matching her passport / DL addresses?

should I bother even using my Canadian address as a "mailing address" and jus send this back with only her US residential address and no representative form?


I also now have the joy of putting this all back together and of course, a new updated form is out july 2016 on my sponsorship form. Figures!

Yes, you either need to enter both residential and mailing as the Canadian address or include the Use of Rep form.

A few people have had this problem. If you list your residential address as one place, but ask for all your correspondence to be sent to another person, CIC needs to confirm that said person is authorized to receive it.
If your spouse is visiting you for the duration of the application process, it's likely better just to list the residential address as the Canadian one.
If not, then fill out the form and send it back.

I was under the impression that her "residential" address cant be my Canadian one as it would be implying she is already living here without proper documents.
for all intents and purpose I found most people say despite a us citizen maybe visiting here nearly fulltime (jus bouncing back ever 6 month to reset vistor time) you should still proceed with application stating she is currently just a visitor. As that's all shes legally allowed to be?

I think the best option would just throw in the representive form with her giving me permission to have documents released to my address?

She is "visiting" you, but she is still "residing" at your address. ;)

And, the simplest thing is to change the address.

If she is actually living with you, you can use your Canadian address as her residential address - she is here as a visitor, yes, but is still living here.

I would send in the Use of a Representative form anyway - this way you can get information about her side of the application with no issues.

Hey there.
This is my first time posting or replying to anything on this site but I must say if it weren't for this site I don't know how we would have ever finished our applications. The guide is so horribly vague.

That all being said my husband and I are in the same boat.
We are applying outbound for me to sponsor him. He has been with me here in Canada for almost 6 months and if his extention is granted the plan is for him to stay here with me during the while application process.

Before he left the UK to come here he was living on site at work. Coming here meant leaving his job /official uk residence. We listed my address in canada, where he is staying with me, as his residential and mailing address.

I've done alot of reading and as far as I know there is nothing wrong with staying in canada while applying outbound.

Our application were sent back with a letter stating we had to list an address that reflects the principle applicants
Residencial address OR send a completed form for representative that will.give cic permission to release documents to the address listed.

It's so frustrating because , as was stated before, they have my husbands email so why is this even an issue. We told them in detail that he is staying here with me and we plan to apply for an extention so they know he is staying with me at this address and he doesnt have an official residential address in the the uk to list. We do have a letter from his sister saying that if need be my husband (her brother) will always be welcome to live with her if and when he needs to return to the uk. He was also told he always has a job to go back to but it would most likely be at a differant location.

Sorry for my rant. Ok so my questions are

What did you end up doing and was cic satisfied with your applications that you returned once corrected.

Could we list his sisters address as his residential address and mine as his mailing address or should we keep my address as his residential address and mailing address.

Am I able to fill out the representative for even though I am his wife and sponsor so he can sign to give permission for these forms to be sent to my address?

So I always had her brothers address in the states listed as her residential but yes I put my address in Canada as her mailing address.
what I ended up doing was just filling out the use of a representative form and re submitting it as it was. It seems silly and redundant IMO but yea CIC was satisfied, it never got returned, and we actually got her COPR this month.
So that was 4 months after re-submitting, it was a complete US outland application.
My wife plans to land just before Christmas after she visits family and gets her list of goods compiled.

And yes this forum is amazing and I thank everyone who contributes to it!

What was highlighted the "use of representative form" ?

Did they ever send you an email?

Are you certain that you listed his residential and mailing addresses exactly the same? This issue has been seen before but only when the applicant gave different residential and mailing addresses.

You don't need to list his sister's address. Keep the Canadian address. You can put yourself as his representative.

Yes I am sure both addresses were the same. I've read on other posts and forums of people having my same issue. And as I've read before alot of people have concluded cic is pretty inconsistent and vague when it comes to this specific topic. Really depends on the person reviewing the apps from what I've read.
I will do just that then and give his sisters address as his residential address and mine as his mailing and fill out the use of rep form.
Did you send any proof of residential address or rather do they need proof? I only ask because he hasn't officially lived with his sister but like I said if he needs to return to the uk that is where he would be staying.
Or since he is staying here can we still list my address for both and just send the use of rep app?
Sorry I over think all of this -_-

Excuse my ignorance to this question but my wife (Canadian) is sponsoring me and we're going to mail out in the next week or two. Should we send everything from Canada with her address?

Yes you will mail everything from within canada. Her apps to sponsor, your apps for PR along with supporting evidence and documents all in one package. Just have it in order as listed on the checklists. Once they have everything they need they will send her a letter of recognition and they will start to process her apps. Once she is approved they will forward your apps. If you are applying outbound they will send your apps to your countrys visa office. Pay for both processing fees aswell as your pr fees online at once. Print your receipt and send off :) Because she's sponsoring you she is the one who is responsible for sending everything. It says in the guide once you've completed your pr apps to send them to your sponsor so they can mail it all together. As you've read here if you plan on listing your mailing address as hers make sure you fill our the use of representative form and listen her as a rep so you can give cic permission to forward anything to do with your apps to her.
