application returned from buffalo. asking for h1b approval notice

My FSW application for category I ( 38 approved NOC) was returned saying I need to send h1b approval notice.

I had send a H1b approval notice but that expires in april.


Has similar situation happened to anyone. Any ideas whether they will return it again since my H1B expires in 2 months.

When did you send your application to Buffalo?

If you have filed for H1B extension, then send your USCIS receipt notice if you have it. If you don't have it, then wait until you receive it and send your application again along with a copy of that receipt notice. If you have not filed for H1B extension, then I would speak to a lawyer or consultant if I were you to see what you should do. I am guessing what the visa office want to see is that since you are filing from the US, you need to show that you will have legal status in the country throughout your process. Two months is not enough time to finalize an FSW application in Buffalo.
