Hi !!

I am new to this forum , i wanted to know if I can apply for a reconsideration of my rejected application for permanent residence under the skilled worker category. My application was rejected because they say I did not fulfill the criteria for proof of funds. Now to prove my funds I had sent them a photocopy of a draft in my name for a sum more than the required amount for two i.e( more than 15000 canadian dollars). The person mistook that for a cheque, in addition i had also sent documents of valuation of my property to serve as a back up if more cash be needed if they accept my application.

The person has rejected my application because he mistook my draft for a cheque and he thinks my affidavit for the ownership of my property is not satisfactory. Now I am ready to convert the amount in draft and deposit it in the bank for the statement, why i did not do so in the first instance was because the draft was made in Canada by my uncle who is a citizen of Canada, and he gave this as a gift to support me in Canada. Moreover I thought that this was the best possible way to show transferable and unencumbered funds.

How should I apply now for reconsideration or is there other means by which i can process my application again

Please help

Hmmm,
It is nonsense rejection, the only thought that I have to write them at once, do it urgent, maybe they will understand, or try to ask a lawyer, aren't there online consultants?
Do something, it is crazy to be rejected for that, I am very sorry, but I hope that they will change the decision, try any thing and everything and don't lose time.

Because it is not permitted to "borrow" funds for this purpose, the fact that the money came from your uncle is a problem. Moreover, since it is not in an account it is difficult to trace the origins of the funds.

Others may have better suggestions, but I think you will have to do 2 things -
1) Deposit the funds in an account that belongs to you, and provide the type of documentation requested.
2) Prove it is a gift and not a loan. I think your uncle will have to provide a sworn affidavit to this effect.

Even so, it may be difficult to convince the IO.

Sorry to hear your plight, but I agree with jes_ON's observation. When the IO saw that the draft is from your uncle and you only had a property in your name (the valuation of which is subject to many things, and they won't be bothered to look deep into that), s/he must have thought that you don't have enough funds on your own.

From what I've experienced and heard, it is very hard to reopen a rejected application; however, I've read one person's account here of being granted that privilege. So, immediately encash that draft or fund your own account with enough amount and try to fax/e-mail an appeal to the visa office with the proof. Also, be prepared for re-applying if that doesn't work out.

By the way, could you share the exact wordings of the rejection letter here? I believe this is the first time an application is rejected due to lack of POF.

hi sorry about the rejection.
they clearly say in bold in the guidelines that the funds should not be borrowed !

i have learnt from this forum, not to rush and to read all the fine prints carefully (advise from charmeuse 2 months ago).

i do not know why people still show valuation of properties etc ( you show that while you apply for visit visas, to prove that you have properties/investments to which you will come back to and not a potential immigrant!).

it has to be funds in bank account or Fixed Deposits , for a sure shot convincing on the proof of funds.
