Application for Work visa from outside Canada

Hello, hoping somebody can help us:
My wife and I are work permit holders (separate work permits - not a spousal permit). We both came separately to Canada and later married and have twins born in Canada (babies were born last year).

My wife and the babies along with my wife's brother who was in Canada at the time left to India last year. I stayed back. My wife had applied for an extension of her work permit which I received later after they had left to India. New work permit validity until April 2024.

With the new work permit, my wife applied for a work visa to enter Canada.

Date applied: April 07, 2022.
Status: Processing - no decision made

We have applied for several web forms. All replies says, its processing.

Any rough idea when my wife would receive an approval for the work visa?

So she applied with a LMIA? Once she left Canada her extension was invalid. Not much she can do but wait.

Does your wife have an approved LMIA? So only status update is processing? An extension is only good if she had remained in Canada. Not much she can do but wait.

My wife's work permit is an open post graduate work permit. She did 2 years of studies in Canada.

At the end of her program when she applied for her work permit for 3 years, she did not realize her passport was getting expired. Hence the original work permit she received was only valid until March 2022, coinciding with expiry date on the passport, with a note saying - "work permit limited to passport expiry date. Extend once new passport is received."

Hence, we had the passport re issued and extended the work permit with a copy of the renewed passport. Hence, she received the new extended work permit until May 2024.

However, she left to India before receiving the extended work permit, but could not apply for work visa stamping prior to leaving Canada.

Hence, she applied for the work visa stamping on the passport from India on April 07, 2021.

Once processing is done, my wife can still come back to Canada, right?

Does she have a TRV to enter Canada? She had an approved extension so there was no need to apply for a work permit. She needs a TRV to enter and then once in Canada, she has her work permit.

I have applied to extend my work permit. Can I travel outside Canada? (cic.gc.ca)

I guess you meant she applied for TRV based on work permit. It seems quite long. Did she apply in new ircc portal or with gckey?

Hi,

Yes, she applied through an immigrant agency through a new profile in IRCC with gc key.

And yes, you are right. She applied for the TRV in April and still hasn't got an approval.

Any idea how long would this take? Anything else we can do to get the approval faster? Or do we have an option without TRV and based on her Work permit she can enter?

One thing to add: I travelled to India earlier this year and carried her original work permit which I received. Hence my wife is in possession of her extended work permit now.

She cannot enter without a TRV as a work permit is not a travel document. Ask your consultant for update on where her file is - eg. started eligibility review. You cannot expedite. You can raise a web form and ask for status update. You can call your MP but they can only ask for status update on her file. Processing is 5+ months so all you can do is wait.

Thanks for your reply. However, this has been 7 months now. I did omit to include she did get a letter in between asking her to do a "Repeat biometrics". The letter indicated they had some trouble retrieving her biometrics info from when she did her biometrics in Canada prior to applying for her original work permit. Could this be a reason why to explain such a long processing time?

Do you know, if in my situation, do you feel like something went wrong, probably due to some application mishap in the way the agency did her TRV application? Anything seems off here, now that we have been waiting since April, do you think?

You applied through a consultant so ask your consultant where in the process the application is. Her application will state “biometrics received (or not)” in the update.
