Application For PR in Canada with a few twists. - Please Help!

Hi everyone!

Very new here but have heard amazing things about the support and information given here I thought I best ask the people who know what's going on!

Ok so here is my situation:

Me: Australian citizen, 34yo, have previously lived in Canada for two years on a Working Holiday Visa.

Partner: Canadian citizen, 29yo, currently living in Australia on PR.

We have two children, One born in Canada and has dual citizenship. The youngest was born this year in Australia and is an Australian citizen, I am currently getting his Canadian Citizenship application organised.

We were married on the 29th of March 2014.

Our plan is to move back to Canada ASAP. Though we are not sure what is the best way to go about it. Ideally we would all like to move to Canada together but my partner is itching to get home as we have very little support for our children in Australia as my family all live in different corners of the country! We would receive much more support in Canada with her family who all live around the same area. I understand that the Partner Visa Application can take up to 12 months from outside of Canada. Not sure my partner can wait that long! Don't know much about moving to Canada without a visa and applying for it there. Would that be a better option? I would ideally prefer to work while I am over there. If I can't work then I would possibly stay in Australia while the rest of the family move back to Canada and work until I get my PR. Confusing I know but that's why I'm here! To get some clarification on the matter! ???

I really am in a bind and would love some feedback from anyone who has gone through a similar process. ;D

Hi

I would advise you to start going through the entire application package. Read the guides, go through all of the forms and familiarize yourself with the process http://www.cic.gc.ca/english/information/applications/fc.asp. It generally takes at least a month to actually get the application together, so start ASAP. You can submit the app from Australia or from Canada.

Until your PR application is approved, you cannot "move" to Canada. However, you can enter as a visitor without a visa and, if needed, extend your visitor status while the PR processes.

The posted processing time is not an average; it's how long it took for 80% of apps to be processed. Sydney is a very fast VO; the time to process 50% of apps is only 7 months. You guys are married with kids, so provided you have a straightforward app without red flags, you will most likely be around that 7 month processing time. You can't work in Canada during the process. Depending on your circumstances, you can choose to remain in Australia and work until your PR app is approved.

So in your opinion, what would be the best option to go with? We are fairly open to any avenues though as I said, I would prefer to be working in some capacity in either country.

In order for you to move to Canada, there is really only one option: apply for sponsorship.

As for the other decisions associated with the process, such as when to actually come to Canada, those depend on your individual circumstances, so I can't really say what is best for your family.


If you can't afford for both of you to be unemployed in Canada for several months, then it might be financially best for you to stay in Australia to continue working throughout the process. If you don't want to be away from your family, then you would have to convince your wife to stay in Oz for a bit longer.

Sending off your wife, new baby and (I'm assuming) toddler to Canada for however many months while you stay in Australia would be very hard on all of you. If you can afford to be unemployed for awhile, then consider coming to Canada together as a family.
