Yes indeed. But i can't imagine being physically apart from your child for up to 2 years, would be acceptable to her!

I missed that part. Yes definitely if she can travel to the US with no problems, then they should just run to the best state for same-sex couples to marry in, and not even bother with the Canadian tourist visa app.

Though i'm curious, how does a citizen of Philippines get an open US visa? Is this like a green card for employment?

Clarity - A US tourist visa is all you need. If your partner can cross the border and get legally to US, you should meet in a state that permits same sex marriage and get married. That marriage will be recognized in Canada and any other state that permits gay marriages. Why bother waiting and paying for a Canadian tourist visa?

its almost the same, we have to get a plane ticket goint to the states. instead if we apply for canada tourist vise here in the ph the cost is much lesser. and getting married directly in canada is much easier than going to the states and get necessary documents and look for a state that permits same sex marriage. i just wanna know if ill be applying canada tourist visa, my us tourist visa would be helpful to be approve?

It will not hurt, that's for sure :) Especially if you've already used it - went to US and came back without overstaying your limit.

Anyway, it will not hurt you to mention it, I'm sure. But the most important thing to get the visa is that you convince the visa officers that you have really strong ties with Ph and you have enough reasons to definitely return in the allotted time. Your son remaining in Ph will definitely do that. A round-trip ticket will be a plus. As will be presenting documents that you have properties and a fairly good life in Ph.

Actually I have'nt used my us tourist visa. I dont have plans on going to the us though my dad is there and family relatives. My partnes is in Canada that's why I have'nt use my visa. and my partner will sponsor my visit,the only thing that I can show to the immigration that ill be back is my son. is itenough proof that ill be coming here in the ph since i dont have properties on my own?

I think it's pretty self-explanatory, but I'll give it a go.

Transit Without Visa means that if you are from those countries you can travel to USA, with a valid US visa, and have a plane change in Vancouver or Toronto. But you are not allowed to have layovers or overnight stays - actually I'm pretty sure you are not allowed to leave an isolated part of the airport. More than that, you will have to go through the U.S. in-transit pre-clearance facility between flights. The only way you could get a temporary resident permit is if you miss your connecting flight or if you arrive outside the US in-transit hours of operations.
