Application cancelled because of error in dates (police certificate) lived in a country

Hi All,

I just got a cancellation for my CEC application. The reason was simply the date I entered for my spouse as lived in a country is different from the date on the police certificate. Basically, CIC stated in the rejection form that the date I entered in my address/personal history is:

from 2007/11/01 to 2008/09/01.

the date on my passport is 2007/11/24 to 2008/09/30.

date on the police certificate is 2007/11/24 to 2017/08/09. As you can see, the only difference between the police certificate and the actual dates on passport is the date he left the country (2008/09/30). This is because according to the police law of the country, (as we were told) date you left must be the date you are issued the police certificate. The argument here is that you can come back to commit crime in the country, so they don't write the date you left but the date you applied/were issued a police cert (this reasoning is strange and weird actually).

So, my question is

(1) can I request my personal history information from CIC (as this can no longer be viewed on my portal). I want to first verify that the date I actually entered in the personal history form are what CIC quoted in my refusal form.

(2) given that this police certificate is still the same form we'll be using to make a new application - the only thing that will change is the 'right dates' in the personal history form when filling it, can we appeal this decision - something like providing the right dates (if peradventure I actually entered wrong dates when filling the form). For example, I can point the 'nice' office to my passport pages where the date entered and left are visibly written?

I think the issue is actually with the date she entered the country, since the police certificate seems valid starting 2007/11/24 whereas CIC thinks she entered this country on 2007/11/01. The dates do not have to match, however the police certificate must cover the entire period of time she was in the country.

You should raise a CSE ASAP showing proofs (passport stamps) that she entered the country on November 24 and not November 1st, meaning that your PCC is perfectly fine (join it to the CSE as well).

I am like 80% sure that it is due to format of the form, i.e., you can only specify the month and year but not the specific day. If someone can confirm, you can explain this in the CSE (basically it is not your fault and you did not provide wrong information, just the stupid form did not let you put the exact date).

Oh, thank you so much @ Binabik for the clue on the possible error from the form format. I was also suspecting the 'day' error in date might be as a result of how the form is formatted - looking at the '01' that the 'from' and 'to' have in common. I also just checked my file to verify all dates I entered and could confirm that the 'to' and 'from' dates on my passport are the dates I wrote down in the form.

Would be really helpful if some in the house can confirmation the date format in the address/personal history page.

So, basically, what I need to ensure now is that I either get a letter from the country stating that the date one leaves the country, according to their law, is the date the police certificate was issued - August this year in my case - and not the date one left their country, OR write a letter myself explaining that. I suspect the former is safer, though.

I actually wrote a note when I first sent a CSE in which I uploaded a corrected police certificate. In the note, I explained that according to the law of the country, criminal investigation is usually carried out between when one enters the country and when one is issued a police certificate - not when one physically left the country.

The issue might be because of error in date of the police certificate as I have had to re-submit on two different occasions:

In the original certificate I submitted, there was an error in the date I started living in the country BUT I submitted this but re-applied for a new police certificate. So, I uploaded this and sent to CIC. Unfortunately, there is a slight error - a letter was visibly altered in the date. '7' was changed to '8' in 2007. I submitted this but later when I read on the 'help' column on the application portal that no letter must be altered, I reapplied for another police certificate and then resubmitted when I finally got it. The final police certificate submitted bears the right dates (but again, with 2017 - actually it is worded thus - a check has been carried out on Mr X and we can confirm that he does not commint any crime between ---- and xxx (xxx being the date the certificate was issued).

This is really a complicated issue. I was thinking of 3 possibilites:

(1) if going by what @ Binabik earlier said, it's possible the officer used the first police certificate (with wrong dates) OR
(2) they want the date to specifically show the actual dates lived there (though I was assuming CIC would probably have treated/approved applications with police certificates from that country. OR
(3) having to change dates 2 times is raising a flag, given the sensitive nature of a matter like this.
