Guys I've something to share with you. On Nov 1, 2013, i emailed CPP-O (at OttPilot-immigration @ cic.gc.ca) regarding 5 points (adaptability factor) for completion of 2 years of PhD study. My email was as below:

Dear Sir/Madam,

I am writing this email in regards to application for Canadian permanent resident under "Federal Skill Worker - Category 3 (as a PhD Student). I am a PhD student at the University of XXX, for last 3 years (full-time student since September 2010). As I have completed more than 2 years of full-time study but have yet completed my program, will I be eligible to get 5 points under selection "Adaptability" factor. I did go through to the FSW guide in your website but I am confused if I have to finish my program to get the points or not.

Today I got the reply as below:

Dear PhDStream: Regulation 83(3) states that the program of study must be completed in order to receive five points for adaptability. Furthermore, OP 6b, section 9.15 states "Award five points if the applicant or accompanying spouse or common-law partner completed a program of full-time study of at least two years' duration at a post-secondary institution in Canada, if this occurred after the age of seventeen and with valid study permits. (The person is not required to have obtained an educational credential for these two years of study in Canada to earn the points, but simply to have completed at least two years of study.)" Completion of a program of study is required to obtain these points.

We trust that the above fully responds to your query.


Conclusion is we are eligible for 5 points for 2 years of PhD study, in progress. I am counting on it. Currently I have 66 points without the 5 points. With this confirmation, I now have 71 point .. so soon I will be applying :). By the way I have been rejected once (applied under CEC on Spet. 2012 with full-time RA and they rejected on Aug 2013 on the basis that they cannot differentiate my RA work and the work for my thesis)

At the end of their reply they are saying:
Completion of a program of study is required to obtain these points.I think they are saying "no" to you as you have not completed your program. You just completed 2 years of your program.
In addition, it is so weird that they referred to OP 6b not OP 6c!

Yes, I have already updated them one year ago with a job offer as a PDF. At least, those should be counted as working experience. I do not know what I should do now....

Could you give us more information regarding the circumstances of your rejection? was it due to the fact that you were missing the lead statement or substantial duties in your reference letter?

I think you are right.

Here is the original reply. What should I do? I need your helps!!!!

ubsection 75(2) of the Immigration and Refugee Protection Regulations states that a foreign national is a skilled worker if:
a) within ten years preceding the date of their application for a permanent resident visa, they have at least one year of continuous full-time employment (37.5 hours/week) experience, or the equivalent in continuous part-time employment in one or more occupations, other than a restricted occupation, that are listed in Skill Type 0 Management Occupations or Skill Levels A or B of the National Occupational Classification matrix;
b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification; and
c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.

I am not satisfied that you meet these requirements. Your period of work experience as a Teaching and Research Assistant (NOC 4012) at McMaster University does not meet the requirements of b) above as the duties listed in your letters of reference do not match the actions of the lead statement under the NOC code you selected. As such, you failed to demonstrate that your periods of work experience met the requirements listed above.

Just an update on my application, I received the passport request this morning. :) and stay positive guys. I was also rejected last year due to the fact that CIC didn't accept my Phd work experience letter and then I applied again under the new rules.

I was wondering about this too. OP6B is obsolete, and no longer applies to applications received after May 4. I wonder why they seem to purposefully go out of their way to pick the wording from old rules. From OP6C, it is very clear that the adaptability points should be given, even if the program is not completed, so now they just choose to apply old rules if people are actually benefiting from the new ones?

Maybe they thought he had already applied. Otherwise, they are misleading him! I was wondering what would be their response if someone email them and ask about these pionts referring to op6c!

Sorry, but they said "No" to you. Did you apply before May 2013?

They didn't accept my PhD work experience letter last time. :( No, I didn't provide any letters or explanations in my second application package. What is your current status? Have you received the file number yet? I think it might have something to do with the post 4 May rules.
