Hi....just a few things that might help
1. Since you transferred from a masters to a Ph.D. i can now see why they didn't give you the points for your masters...a friend of mine had done the same and CIC had clarified that you need a degree certificate confirming that you are a Master of Science graduate in so and so field to get those points...so i don't know if your argument will hold but you can try of course ;D

2. For the arranged employment, have you received an offer in writing for PDF yet?..if yes, include a copy of that letter. If No, i doubt they will accept that claim. As per my understanding, for arranged employment you need an employers letter stating your position, start date and salary

3. And regarding the points for previous study, it seems they are not giving those to anyone who has not completed their degree.

Hope this helps
;)
Hi Anjuku

Thanks for the response. I totally agree with the masters problem as I have run into it before too. I will give it a shot anyways.

For PDF, I have received a written contract with all the details and both parties have signed it. I have sent them this letter on 13th may along with mentorship plan for faculty position and my GCMS inducates its receipt. The eligibility was done on 8th May with those depressing notes. I have updated everything now so as all is there when the final review comes.

For previous studies, thats what is confusing me. I know they have not given it to anyone but CIO is and if we look into OP-6, CIO is doing the right thing CPP-O is not. Just wanted to clarify with them as these points might prove critical in my case.

Thanks for your valued suggestions.

Fingers crossed.

Hey guys :(
Seems I will receive my rejection so soon,
According to the last assessment, I received 64 points, they did not give me 5 points for adaptability.
10 points age, 10 point language, 19 work experience, 25 education = 64, I can claim one more year work experience but it has just 2 points.

How long does it take if I go through that way to submit a Job offer?
Is it possible my supervisor give a job offer? (he is adjunct prof)
Any suggestion!!!

Thanks in advance,

I personally think it is a very well worded defense and counter points. I think its logical and relevant and points out to some extent some disparities in inferring rules by various parties involved.

I wish all the best luck and thanks for sharing.
Thank you very. I appreciate your input. I looked at the Section 11 you recommended and I'm thinking it s not particularly relevant to this case, but I will take a closer look at this.

I wish I could afford a lawyer or find a way of reaching out to them for a proper explanation.

I think the officer is trying to say that it's not possible to obtain full-time RA experience while you engage in full-time PhD study.

You should have a look at the definition of the full-time study in Op6-b.

I totally understand that fact, which is the objective of my response. If you see the database of timeline you will see the number of PhD students in this forum who have used only RA experience and got PER and PR.

The law clearly highlights the requirements.

Thank you anyways.

yes that is true, but many on the forum like asbereth have highlighted the need to claim reasonable hrs as RA/TA work experience because they can always bring up this argument...a full time student is expected to put in 15hrs/week for study..so it is reasonable to claim 25hrs/week as RA/TA...do you really need to claim the 40hrs/week RA/TA?...i mean if you just need 1 year of woork experience, 2 years of part time RA/TA (20hrs/week) will suffice..but then the question is do you need more than 1 year work experience to meet your 67 points?
Hope this helps

I'd advise you to retake your English test to improve your scores. and forget about the five points from adaptability, you are entitled to claim those when you are done with your current program.

Yes that was my point. You always want to do ur bestest best to avoid the rejection waiting after stressful over one year. I don't think its a good idea to give up before any final decision (from CIC).

I got rejection letter today :).

Your application was assessed based on the occupation(s) in which you requested assessment: XXXX (NOC####), Research Assistant (NOC 4012). The table below sets out the points assessed:

Age 10 (10)

Education 25 (25)

Experience 17 (21)

Arranged employment 0 (10)

Official language proficiency 10 (24)

Adaptability 0 (10)

TOTAL 62 (100)

You have not obtained the minimum number of points, currently 67, required for a permanent resident visa. Your periods of work experience as a Research Assistant do not meet the requirements of regulation 80(3) as the list of duties in your letters of reference do not match the actions contained in the lead statement of the NOC codes you selected.

I am wondering why did they send me the PER in the first place

Any suggestions if I could send a reply or an appeal with updated TA letter and claiming adaptability points ?

Thanks

Thanks Anju for the advice. I will definitely update all the letters with this letter. I have also contacted by future employers to apply for a LMO as they say it to be HRSDC approved. I talked to them and they made me contact their lawyer and I am thinking of providing a letter too stating that the position is LMO exempt for their records.

Thanks for digging up the post from kg. I really appreciate your effort. I am definitely going to try quoting OP6B and ask for adaptability points.

I will update the forum as to what happens hereon, I think I will be ok but lesson learnt is to go through OP6B before filling up the application and order GCMS every now and then.

Another thing I noticed in OP6B that we all have been doing is taking description of job duties from the website and putting on the reference letters. OP6B says if they are copied directly it might be a problem as the officer cant gaze what were the exact duties. So be careful about that. I changed the points accordingly and changed the language a bit. We on this forum I think should keep in mind too. Sometimes too good is too bad.

Will see how it goes.

Sorry to hear that!
They must sent you the PER because the CIO gave you 5 points for previous study in Canada, those points are not approved by Ottawa unless you finished the degree!
Unfortunately, you cannot appeal!
