Hello All,

I am a PR of canada, and I am thinking of applying for my husband's visitor visa and then do his PR sponsorship application once he is in canada.

My question is, are there any rules against this?
And second, will he get the visitor's visa or will the govt be like, why do u wanna go like this , if u can do ur PR app..


We have our own strong reasons for this... wont bore readers with the details.

The worst they can say is no. My wife applied for a vistor visa last summer, and she was refused because people do, do what you are doing which is kind of a loop hole in the system. If your husband omens here on a vistors visa it is also illegal to work.

Other people have done what you're proposing - it's completely legal. However, if your husband is an Indian citizen, it will be hard for him to get a visit visa since he will be considered a risk to overstay because of you, his Cdn PR wife.

If he can demonstrate strong ties to India (job, properties, money), that will count in his favour if he does apply for a visit visa. The worst that can happen is that he's refused. And this type of refusal would have no impact on a subsequent PR application.

For visit visa.

Asian countries are considered high risk for staying longer than visa issued.

Approx 30% spousal visit visa are approved. (Asian)

Refusal at times may have negatives impact on future sponsership for spouse.

Spouse must show legitimate proof he/she will return when visit visa expires. (work proof, study proof, family)

Does anyone know whats the approval rate for India?

We have ample proofs/reasons to provide..
His work, business, offices and his dad has been unwell..and he is responsible for their care, so we can give the medical records for that....
Am I thinking on the rite lines?

Also, someone said before it WONT affect future PR apps... and now someone else added it will..

Well , which is it..
this is mighty confusing and stressful....

No idea what the visit visa approval rate for India is, but as mentioned before, you have nothing to lose by trying except some time and money. For what it's worth, my husband was refused a visa visa but got his PR in 5 months.

If your husband doesn't have several prior refusals to visit Canada in the past (e.g., turned down for study permits or tourist visas), then you shouldn't worry about going ahead if you feel you can provide good evidence of ties to India. The stuff you mentioned above fits the bill but it's always up to the discretion of the visa officer whether to issue the visa or not. Document it as best you can in the application and hope for the best.

If your husband applies and is denied a visit visa, and if you're upfront about the reason for his visit, then it doesn't matter if he's refused. In fact, applying for PR would be seen as the next natural step.
