App Rejected Erroneously - Birth Proof Not Found by Officer

Hi! Can anyone help me on this?

My application received date is 17th December 2014 for NOC 3234, y'day I have spoken with CIC regarding my application status and the lady officer informed me that my application was returned on 12th January 2015 and when I asked about the reason, she mentioned that the “Birth Certificate” was not available with the application, but I have already sent “Affidavit cum declaration ( If in case Birth certificate not available)” since my Birth Proof was not available to CIC.

In this case can I resend my application to CIC with cover note mentioning about substitute declaration which was already attached? Do they going to consider my application for FSW 2014? When I can expect a delivery of my returned application?

My lawyer also doesn't have any appropriate answer on this, plz advice.

i faced the similar problem. Essentially they see the 10th grade certificate for date of birth and then the affidavit. I think they did not get the 10th grade certificate in your application.

did you send it?

if you receive the package back, send it again including the above certificate. Hope the NOC doesnot get capped.

Unfortunately for me it was too late as the NOC was already capped

Off course Yes! I have attached all the requisite documents which include 10th Grade certificate. I have arranged all the documents as per document checklist with sticky notes mentioning description of the document/s. I have attached 10th Grade certificate with educational qualification but not attached with “Affidavit cum declaration”.

Can I resend my application to CIC with cover letter ?

if your NOC is not yet capped, then it is recommended to send them imeediately once you receive your package. I have seen some members did the same and they got accepted the second time.

If the CIC executive has asked you to send the application back, then the chances are high (Acknowledged there error). Otherwise I will suggest you to try in EE.

Is it advisable to drop a mail stating they missed out to check the documents? Or should I wait till physical documents get received and then resend physical documents with cover note mentioning there error?

It will take around 60 days to get a response to your mail. It will be better that once you receive the package, you call CIC and raise your concern. If they acknowledge that it is a mistake on there end, they will ask you to send it back. Till that time I will suggest that you also create a express entry profile to be on a safer side.

This only worked if the resubmitted application was received by CIC by December 31, 2014. Too late now.

For safer side, I think I should drop a mail and highlight there mistake, god only knows whether they will consider or not.

I highly doubt they will even look at the application. They will just return it again. But I suppose there's no harm in trying.

Appealing is really the only realistic option if someone still wants to be considered under the 2014 rules.

Yes I agree, I thought sending it back in with an explanation and a call/e-mail to CIO ahead of time would be considered an appeal? Or only a formal appeal through the courts would give OP a chance?

Unfortunately, they refuse to tell me the rejection reason. I have already sent email to check for the reason meanwhile waiting for the returned package.
