Hi guys. I hired a representative to file my application. I live in the US and he told me that I have to apply in the office in Brazil. However, I do not want to have any interview there because of they deny my case I will not be able to come back to the US. Is there anyone here from Brazil or another country who lives or lived in the United Stated or abroad that had to send the application to Brazil or your home country? Did you have go to to the interview or was it waived? Was the interview in your home country? My representative said that there is a high possibility to have my interview waived. Is that true?

Thank you.

The skilled worker application is currently waiting for new rules that are supposed to get posted next month maybe but true that not everybody gets called in for interview. I applied through London since my home country did not have a visa office and I never had to go there. Depending on what your status is in the US or if you were ever legal in the US, it is possible that you can apply there.

Hello Marcelo,

I'm brazilian and I live (legally) in France. I lived in Canada for two years, and I want to go back. So, I am thinking of aplying for a skilled worker permit. I contacted the Canadian consulate in Sao Paulo, they said I could send my application to either consulate (france or brazil). Since processing time in Brazil is considerably shorter, that's where I will send my application to. As for an interview waiver... I don't know. If I have to go there just for the interview, it's gonna be expensive, but oh well. Maybe it can be done over the phone, or through the consulate in paris. I really don't know.

The processing times listed on the CIC website are for applications under the old system. It tells you what you could expect if you applied before February 27 this year. These timelines are completely irrelevant to the new system. Under the new rules, they have proposed that all skilled worker applications (for those who qualify under the new rules) will be processed within a year.

Hey Eduardo,

Do you have the Canadian Consulate phone number in Sao Paulo? My attorney told me that there is a great chance that my interview will be waived. Well, but we never know. I came here to the US with a 6-month tourist visa. I overstayed. Then, I got my employment authorization. I went to Brazil in 2002 and when I came back to the US, I was issue another i-94 giving me exactly one year to get my adjustment of status. So, I was year another year legally. Then, in 2003 my employment authorization expired and I was not able to renew it. Now, I am out of status and my lawyer told me that I can not apply here. I am afraid of applying in Sao Paulo and then, if they deny my application, I will not be able to come back here. I work for an american company, pay my taxes and I have my social security. Besides, it is too costy to go to Brazil. What is the probability they will deny my case if I go to an interview in Brazil?

Thanks.
