What exactly has changed here? Does this mean that as soon as we get PR we have to live 2 years in Canada together?

It doesn't really change anything for legit couples planning to live in Canada, so i wouldn't worry too much.

I am curious to who is going to check up on this though, seems like a lot of work for an already overworked CIC

It doesn't mention you have to live together in Canada, which makes it ever harder to check for CIC.
I think this is a typical law that is put in place to for Immigration to fall back on once they discover fraud after the fact.

I think it's great!! It gives fraudulent applicants a consequence. If someone uses a person, or if they're both in on it and if someone reports it (leading me to believe it would be more for for people who were 'used'), the applicant will lose their status! Hopefully it will make people like this less likely to go this route, leaving us real couples with an easier and shorter waiting period in the long run! ;D

If you are being abused and neglected, you shouldn't have used the Family Class Sponsorship in the first place.

There is another issue with conditional PR which has created some very tragic situations in the US that have ruined lives.

If the sponsored person is abused by their sponsor in the US, they can complain to officials and retain their PR status even though they haven't lived with their sponsor for the two years. This is a great rule when the abuse is real.

What has (and continues to) happen in the US, is that some sponsored immigrants will falsely claim abuse shortly after arriving in the US because they know about this loop hole. The sponsored immigrant is then allowed to keep their PR status without living with their sponsor for two years. The sponsored person will sometime even end up owning all of the assets (property, bank accounts) that formerly belonged to their sponsor.

The sponsor is then falsely charged with abuse by the police and ends up with a criminal record. In extreme cases where these false charges aren't dropped, sponsors have ended up losing their jobs, their houses/assets, access to chilren from previous relationships, etc.

There are several forums dedicated to false claims of abuse such as these. Some people who have been falsely accused have literally lost everthing and their lives have been permanently destroyed. If you want to read some sad stories, go here:

I don't think there's a sure-fire way to determine if an abuse accusation is false. So I suspect we will see similar situations in Canada.

The sad part about that is that people still think that going on the Internet to find a -rent-a-girlfriend in a foreign country is a good idea.

As a sponsored spouse, I'm pretty glad I filed my application already and will not be subject to this rule. Not because I'm planning to leave my marriage within two years, but because I am sure there will be more paperwork (and fees, you can bet on it) and evidence required by CIC to lift the conditional status after two years have elapsed.

I'm not convinced that this acts as a particularly strong deterrent against marriage fraud. I've read about some cases where the sponsored spouse has been married to the sponsor for several years before PR is granted and then the sponsored spouse leaves the sponsor immediately or soon after landing. If someone is prepared to play the part for all those years before getting PR, I can't see any reason why tacking on an extra couple of years of pretending afterwards is going to cause them any trouble. I can see a lot of marriages suddenly failing after two years of PR. ::)

One situation where I think this will act as a deterrent, is perhaps situations where the relationship/marriage was indeed genuine, and perhaps the sponsored spouse wanted to leave much sooner but decided to stick around until PR was granted as they figured they might as well get something out of the failed relationship. I imagine somebody would be less inclined to sit it out in a relationship, when sitting it out becomes perhaps a matter of years instead of just months. That is a good thing, because the sponsor in that situation is likely to feel just as used as the sponsor in a total fraud situation.

I think the trouble with this is that it does give the sponsor a degree of leverage over the sponsored person ("do as I say or I'll kick you out and have your PR revoked", etc) which is pretty much handing a potential abuser the tools for abuse (and nobody shows themselves to be an abuser right away, at least not until they've somewhat isolated and trapped their victim, so McDutch's post is pretty silly... "hey, I know I just got done beating the crap out of you but do you wanna marry me and move to Canada and leave your entire support network and live in fear for the rest of your life" said nobody, ever ::)).

It would be rather difficult to prove to CIC that your sponsor is abusing you unless physically, so are CIC really going to waive the two years to let you leave the relationship and retain PR in a 'your word against theirs' situation? The thing is, they have to, lest they be seen as enabling abusers, so the door is flung wide open for 'crying wolf' situations.

I guess it's not like CIC can really give any detail on what will and won't be an acceptable situation for the two years to be waived. It should be very very interesting to see what cases come through in that regard. And the thing is, once a few cases have been seen, everybody will know what will and won't work and will follow suit, so I don't really understand how this will be effective after a few years.

Why is it silly?

You use the Family Class sponsorship program to be (re-united) with your loved one, not to take advantage of Canada's Awesomeness.
If all of a sudden your spouse turns into an abusive douche, you book a ticket back. Why stick around?

I agree with the previous post regarding extra paperwork. Somehow I just see this being very tedious for legit couples and not much of a deterrent for fraud. In particular, couples who have a child are exempt, which while I understand the reasoning behind that, gives lots of people another loophole. Having a child for the purposes of immigration is not unheard of and I predict there will be a surge of CIC babies going forward. All I can say, is thank heavens my spouse and I will not be included in this!

I doubt there will be extra paperwork for every couple and that it will more be like a "We can audit you if we have/want to" kind of deal.
