Good day , here is our situation hope you can help. My sister have cancer stage 4 ,she have two kids 7 and 3 yrs old boys. The eldest have autism And 3 yrs old have speech delay. I been here in Canada for almost two years and I just keep renewing my tourist visa to be able to stay and help her family out and the children since my parents are both old. My brother in law has been leaving his family under my care ,he would go out and about , leaving for 2 to 4 weeks ,sometimes for 2 months to visit friends .Then just last may 2020 my sister husband unfortunately left them and decided to stay and work in different province . Now my sister and her kids are under my care and he left all the responsibilities to me. Can I apply for HNC or what our my options so I'll be able to help my sister and her kids more. Being a tourist I'm unable to drive and I'm also scared of getting sick with covid and not being able to get treatment for that if I get sick. I also have kids outside of canada whom I would want to support eventually once I get a job here. I can't leave my sister and kids on this kind of situation.

You’ve been asking this question since September 2019. Totally get the situation but the answers won’t change. It looks like you already consulted with a lawyer so I suggest you continue working with one. No one here can tell you your chances. If you are working with a lawyer, no one here is in a better position than that lawyer to give you the options that you are looking for. Best anyone can do here is guess and that is not what you need right now. Good luck.

You can certaily trying applying for PR under H&C. If you chose to do so, I would recommend that you work with a good lawyer.

H&C approval rates are not high. It's really impossible for any of us to comment on your chances of approval.

Note that processing times for H&C applications is around 3 years. You won't qualify for health care coverage until application processing has completed and you are approved as a PR. So best case scenario, you are still a few years away from being able to work or have provincial health care coverage.

You should also be aware that if you apply under H&C and are refused, it will most likely become very difficult for you to return to Canada in the future as a vistor.
 
Yes , unfortunately the lawyer wants to charge 10k cad and we don't have that funds to get the lawyer to take care it for us. Thank you for all the help guys. I'm still on tourist visa but would like to be able to do more . My sister assign me as a guardian on her last will and we're just trying to at least do our best to secure the future of both of her kids if she passed away that's why we're thinking of hnc. I don't qualify for any program.

Given that the father is still alive getting guardianship is more complicated than just being appointed the guardian by the mother.

Your sister was in palliative care 8 months ago. Not trying to be rude but someone who is palliative care with cancer that has already metastisized to the bone and brain do not usually live another 8 months. She was also very unwell last year based on your description. Has your sister passed away?

Fair point. Based on the previous posts the situation was portrayed as death was pretty imminent. It is 8 months later and the situation seems to be the same. I will delete.

Thank you for answering my questions, yes she's still alive and fighting to live . I applied for humanitarian last year and got first stage approval , would like to ask how can I apply for open work permit. Thank you. God Is good .
