Hello,

I am planning to apply for Canadian citizenship.
I was charged with domestic violence couple of years ago.(3 years)
However i was given peace bond, i satisfied all conditions and my fingerprints are in the destruction process.
- Can you please advice if it can impact Citizen application?
- Can you please tell me if i need to attach peace bond documents along with the citizen application?

Thanks

Hello,
Any can help here with their expertise and knowledge?
Hi san1010,

I am not expert in legal issues but as far as I know:

If you have not been convicted and you have completed the peace bond with all conditions. So, the charges I suppose were withdrawn. Is that correct?

You should not have any issues with Citizenship application. But if your charges are still pending then you will have issues or may not be even eligible to apply. And any jail time should be deducted from the physical presence days.

After fingerprint destruction you should not see anything on your Police background check also. Best is to contact an immigration lawyer and ask this question, should not hurt to pay $50-100 for this. It is important. And if you do please also update here so future applicant can benefit.

Thanks sthaeem for reply.
Yes it is correct
- My charges were withdrawn.
- Completed peace bond with all conditions.
- I was not convicted.

But i am not sure what needs to be answered for Question 8 for:
- an inmate of Jail, prison? Yes or No (I was in Jail for pre bail custody, but not for any conviction).
- an probation? - Yes/no (I was given Peace Bond not sure if i need to say yes or no for this question)
- on parole? - Yes/no (I was given Peace Bond not sure if i need to say yes or no for this question)

To first question .... Yes
All other question no
You should give details in the specified space on the application that charges were withdrawn and you are good
Since charges were withdrawn you should not have problem

Thanks def_col_male.
(I was given peace bond to obey for 1 year)

I am reading that peace bond is considered probation period.
Probation is a court order to do (or not do) certain things for a period of time. It is usually called a probation order.
-----------------------------------------------
lawfacts.ca/node/80 website.

Every probation order will have the following conditions:
keep the peace and be of good behaviour;
appear in court when ordered by the court.
-----------------------------------------------

I am thinking to say yes for all and attaching all court documents.
Any thoughts?

To my understanding peace bond is not probation
You may want to check with a lawyer or some online resource

This is my understanding:
Probation is not a Peace Bond.

Just Peace bond should have no affect as long as it is complete and expired.

My kind advice is to seek help from a lawyer who can better guide you. Its just a matter of few dollars for consultation.

Good luck!
