I'm a Canadian citizen, my wife is American, we applied for PR in Canada about a year and a half ago, I always checked my mail and checked the processing time online. Until one day I checked it and 4 new messages popped up, that they sent me paperwork, request for medical, sent me paperwork again, and finally sent me a decision. We never received any of this, Im assuming they emailed her account but she lost access to that email and they DO have her her other email on file. To be honest we were expecting mail in the post as well but never received on email either. Anyways she called them to find out anything and th gentleman said hel put it in for them to remail it. Im assuming since the decision has been made, we never sent a medcal exam that it is denied. We applied inland and I imagine we cant appeal anything so I'm hoping someone has an idea of what our next step is. Thank you everyone.

Yes - unfortunately it does sound like a refusal. I would complete the medical ASAP - and as soon as you've done that, contact the visa office, let them know you've done the medical (and that you missed their messages) and ask them to reopen your file. Good luck.

Oh no...not another "I applied Inland..." story, from a fellow American! ;)

The good news is that someone here [very recently] was approved without ever having the required medical...which seems very strange.

The bad news, as you're aware of, is that if it's a denial, there is no appeal process.

I'll be cautiously optomistic for you, but if they've sent you correspondence that she/you never responded to...it might be bad news.

Good luck!

If there is no appeal process does that mean we cant even reapply?

You can certainly reapply - but you'll have to go the outland route.

Not at all; you can apply right away...this time using an Outland application (even if she plans to stay in Canada during the process).

As long as she still has legal status, she would simply need to apply for an extension before it expires. An American can complete the entire process with an Outland application in ~8-10 months.

Would anyone recommend speaking to or hiring a lawyer?
I would rather not spend a large sum of money but if thats what it takes to be with my wife, it wouldnt bother me.

Not unless you have/had a complicated application.

In your case, it was...with all due respect, failure of your wife to keep up with her email account that she provided to CIC and/or notifying them to use the secondary email address that she provided to them.

IMHO, there's no need for a lawyer for this.
