Hi everyone,
I'm 27, single, finished Engineering from India and finished 2 year diploma from Canada. I've more than one year experience (IT fileld) from India.
I've finished my studies as an International Student on Dec 2011 and got PGWP on Jan 27,2012 for 3 years. I started working for Scotiabank from March 2012 as a contractor.
Here is the thing, I registered an incorporated company and hired by another agency to work for Scotiabank and now I'm working for Scotiabank through the agency. I'm getting paid biweekly through the agency to my company account.
That means, Scotiabank is paying to the agency and agency is paying to my company. My agreement with the agency is clearly mentioning my name and my company name and I've to work for Scotiabank.
I read from the different topics that self employed is not eligible for CEC. But since I've an incorporated company, T4 for myself and I can provide letter from my agency and Scotiabank do anybody think that I can apply through CEC? if not which category I can apply for?

Anybody who's a contractor and got PR through CEC?

Please help me

Your case is not different than many others. You are very much eligible to apply under CEC. It is not required that Canadian work exp has to be acquired as a full time permanent employee. You are not self employed but a Contractor. Go ahead preparing your CEC package.

Thank you for the response. It is mentioned in the cic website that self employed is not eligible for applying on CEC class.

I want to know how Immigration officials describe self employment. Still a confusing situation. I don't want to risk continuing working as a contractor with Scotiabank and risk my Permanent Residence.

I want to know if anyone got PR evenif he's self employed.

My work permit is Post Graduate Work Permit. ie Open Work permit. I finished 2 year diploma from Canada after that I got applied for work permit and got 3 year work permit, ie Post Graduate Work Permit (PGWP).

I would say best case scenario the VO will apply his opinion as your situation is open to interpretation, my opinion is that you started your own business and you are workign for yourself.
FYI it is worthless applying as self employed, I have 2 self employed applications once since 2006 and one since may 2012, here's what the MP sent me just before the holiday
:"Further to your email, I made an enquiry as to the status of your application. I was advised that Self-Employed Applications take many months, and although there is not a processing time listed on the website for the Ottawa Pilot Program, which is where your application is, you will note that the times listed for New Delhi and Hong Kong are 91 months and 68 months respectively. This gives you an indication of the time it will take. The link to this page is below:

The Canadian Experience Class is a completely different program, and that is why applications are processing at a different rate."


I didn't post this before as I thought people here always complain I am being negative, which I am, but for a reason.

your only option is to find away to apply as CIC or SW as IT is not accepted for self employment too, it has to be farm managment or cultural activities.

Sorry your reply is not clear for me. I would like to know, in my scenario (explained in the post) am I eligible for applying in Canadian Experience Class (CEC)? I don't want to apply in the self employed/investor class.

I have a doubt, CEC is open for Temporary Work Permit (TWP) and Post Graduate Work Permit (PGWP) people.
It is mentioned Self-employed is not eligible but I don't know if its applicable only for TWP people or PGWP people..

As Andy2109 mention, You are eligible to apply under CEC. Eventhough you are on contract but you have worked full time (37.5 or 40 hrs/week) so you are fullfilling basic requirement for CEC. It is not required that Canadian work exp has to be acquired as a full time permanent employee.

One of friend got his PR under CEC (he worked for TD but through an agency). He graduated from Canada (2 Year diploma) and had Post Graduate Work Permit (PGWP) for 3years.

Note: Please make sure with agency if they are able to provide you detail refenrce letter (including detail duties or responsiblities, pay, work hours/week etc.) because this is one of the requirement.

This is open to interpretation with every person having their own opinion, my opinion is that you are working flexible hours that you decide, at your own location, without a boss above your head, there are many things they consider to judge if you are self employed or not, and they will see through your applications details that they will use to decide. I have called them many times and discussed this with them, maybe you should do the same. If things were so easy maybe I should have my business pay me through a payroll compamny get some T4s and apply as CIC myself.

Kaur13 - Can you please help me in directing me in right way or what are the specific documents that your friend submitted while he applied.
I want to know how your friend provided the T4's for his/her employment. Is your friend having own company sole proprietorship/incorporated (T4 has to be issued by our self) or a direct contractor (which bank will provide T4 by the end of the year)?
