As far as I know, No you cannot apply from ND if you are in the US for 2 yrs.

Wrong, if they are Indian citizens, they can apply to ND.

As long as u r a Citizen of India u can apply thru ND visa office ..

That is correct. You have the option of applying through your country of residence or your country of citizenship. EG7 states:
Visa Office requested for the processing of your application: You must
select and write the name of the Visa Office which serves:
 your country of nationality; or
 the country in which you are residing, provided that you have been lawfully admitted to that country for at least one year

I sent the application to CIO, NS with mention of buffalo visa office, Can we request to change it now to New Delhi?

Can we ask Buffalo CHC to tranfer our file to ND.

Our file is sitting on the pile on somebody's desk (dust) from July 30th 2009.

I know ND is processing faster these days?

Can we tranfer - any feedback?

You can ask and they will say no.

Here is the Operations Bulletin 180

"Visa offices are not required to transfer files for any other reasons. Such reasons include cases of applicants who comply with subsection R11(1) for the specified visa office, at the time the application is received at the CIO, but subsequently leave the territory of the specified visa office. In these cases, the original visa office should proceed with a final determination of eligibility and process the application if eligible. The visa office should not transfer the file to another visa office unless the transfer is warranted for program integrity reasons. Leaving a visa office’s territory alone does not warrant a file transfer. In this case, if an applicant requests a file transfer, the visa office should inform them that the application will not be transferred and that they are required to submit a complete application to the visa office originally specified within the 120 day deadline allotted by the CIO."

I am in US for 5 years and submitted my application at ND. Thing to worry about is sending passport with someone to India and getting it back. Also hopefully they dont call for interview.

no one is supposed to send pp across the border of any country (of course he is admitted and living in legally)...

one will be in SERIOUS TROUBLE if this is caught.... and it can be verified easily anytime looking at immigration stamps.

people are taking it easy.... but not good.

I suggest you check your facts. There are very few passports that can't be mailed in or out of the their home Country. India is one of them. Although you can authorize a person to hand carry Indian passports in/out of India.
