I have forwarded my sponsorship application to BUFFALO NY and was processed there. After the agony of waiting and waiting... we are scheduled for an interview in Nov. Since the US embassy in Calgary is not accepting anymore appointments OL, I contacted them and was lucky to get an appointment to get a US visa application for my spouse. So then, we drove to Calgary and all those troubles did not pay off.... My husband's application was DENIED and can not be appealed at all!!! :'( That means we can not go for the interview unless we get a US visa which was FLATLY DENIED!!!


Is there another way for this??? What happens if we requested for the application to be forwarded to our homecountry?? (Philippines) Or even forward them here in Canada. Is it possible to transform the OUTLAND application as INLAND instead? What are the measuressss????

Nope you have to wait for the original app to be closed and reapply.I dont understand who told you to send your app to Buffalo in the first place.Buffalo timelines are not much different than Manila actually Buffalo is 10 months Manila is 9????
Well now you have to wait till it is closed then reapply through either inland if he is here which will be still much longer than if you apply through his homeland.

I am confused - what made it possible to have your application processed in the US if your spouse doesnt live there?

Before we mailed our application, somebody told us that BUFFALO is faster than Manila. I dont know, I am so confused now. The immigration allowed our application so I thought it was possible.

So how long am I waiting for the case to be closed? That really sucks!!! We waited and waited for so long and now we would have to re apply!!! OMG, this is killing me! All those troubles for nothing... nothing... nothing...

The interview is scheduled for November. Contact the Buffalo office and tell them about the problem. Probably they will not do anything to help, though. Also call the CIC help line and ask for their advice. Probably nothing can be done, but at least you will have tried. As well, if you find out that there is no way to get the interview somewhere else, and that without the interview the application will be denied, you can choose to stop the application right now. And then submit a new outland application to Mississauga - going through Manila. Starting one now is better than waiting till you get the rejection letter in December or so, if there is no chance of a successful application now.

If a temporary resident was legally initially admitted to Canada for a minimum of one year, then you can have Buffalo process your PR application. I had the option of processing in Buffalo since I was initially admitted to Canada on a 2 year study permit. I currently have a valid OWP right now. I prepared almost everything to send it to Buffalo but when I did my medical, I decided I wanted to go inland to avoid what happened with OP's husband right now. I am from a non visa exempt country and I thought "what if I sent it to Buffalo and they required an interview and I am denied a US visitor visa?" It is hard for citizens of my nationality to get a US visa especially since I would be applying for it from Canada and not my home country.

There is no way to a appeal a denial of a TRV. You can reapply but I know sometimes they give you a time limit before you can reapply. You cannot switch from outland to inland and I doubt at this stage you can ask to have it transferred to the Philipines. If the PR applications gets refused (which it most likely while if he doesn't make it to the interview), you will get back your RPRF if you already paid and then you can reapply outland or inland. Good luck

Thank you. I knew I had read somewhere the reason but couldnt find it. Thanks for clearing that up for me!

I did email the Buffalo about this problem since there is no way to call them. CIC help line is closed until Monday. If I stop the application right now, how soon can I re apply. Time is really tight since my husbands WP expires on Nov 20 this year.

Also, if I reapply for inland, how soon can my husband get an OPW?

All I was thinking before was for the faster process and that time, BUFFALO was "faster"than anywhere. I didnt even think about the US visa. Philippines is the headline news right now, which made it even worse to apply for anything.

If I re-apply, would I have to pay for the full fees that I just paid on the initial application?

First stage approval (this is when the work permit is granted) for inland applications is currently taking 8-9 months according to the CIC web site.

You can reapply as soon as you cancel the application.
If I re-apply, would I have to pay for the full fees that I just paid on the initial application?
Yes, as it is a new application.

Spouse in regards to cancelling the application the process was farely quick when we did it. They recieved our withdrawal letter and within 1 1/2 months the application was withdrawn and file closed. We recieved the refund a few days letter as well as our whole application. I'm not sure if the times would be the same with an outland application.
