Am i still eligible for BOWP?

I lost my status in December and just received AOR (CEC PR application) today. I could have applied for BOWP without AOR before my WP expiry. Unfortunately I did not come to this forum until recently and was not aware of this possibility.

My employer is doing a LMO for me trying to restore my status and I am not sure what chances are there to get a positive LMO and how long it will take. meanwhile, I am wondering if I am still eligible to get a BOWP.

Please give your suggestions, I appreciated your help.

Unfortunately you can't apply for a BOWP at this time.

You need to restore your status and get a valid permit again before you'll qualify for a BOWP.

As scylla said, unfortunately you cannot apply for BOWP I believe due to your work permit being expired.

I think you could restore status as a visitor temporarily but not as a worker until an LMIA (LMO) is approved. I am not 100% sure on this, hopefully someone will prove me wrong. Good luck

As others mentioned unfortunately BOWP is not an option for you anymore!

You can most definitely apply for a visitor permit. Specially since you have your AOR. They will grant you 6 months, meanwhile you can push for your LMO / LMIA! I'm not sure how your employer is taking care of it, but it's a tough task. Even if it doesn't go through, don't worry you can most definitely extend your visitor for another 6 months till they come up with a decision on your application. Hopefully you'll be done within the first 6 months. But I had to extend mine for another 6 months so I don't stay out of status.

All the best mate, it's going to be a bumpy road, but keep on going. Before you know it you are going to land as a PR.

Can i restore my status by applying for a visitor permit first and then apply for BOWP?
Will I be eligible for a BOWP as a visitor?

I could stay as a visitor but i need to work if possible. Also, i have two kids and i am afraid they won't be allowed to attend school if i don't have a WP.

Thank you! This really helps. But didn't you try to get a BOWP with your first visitor permit? or you knew BOWP was not an option any more?

Sorry mate, it clearly states that you need to have a valid work permit to apply for a BOWP. So it's not possible for you to go on a visitor permit and then apply for a BOWP.

I am speaking from experience. At least what I went through when I had your situation. I even walked into CIC office in Vancouver after I got my medical request and tried to get a BOWP because I was super desperate financially. But they told me it's not possible and I have to wait for my PR to get through. Although they told me that I can send CIC a letter and explain my situation, if they issue you a letter that indicates you are eligible, you have done your medicals and also have paid your RPRF (which I did and I was absolutely at the last stage, waiting for my PPR), you might have a chance to get to the border and apply for a BOWP. This letter has some official numbers on it so it gets through their system and they can issue a work permit at the border. Which is useless obviously, because if they can issue the letter they can issue the work permit as well. At that stage there was no point for me to do that and I am pretty sure it was impossible and the officers didn't know what they were talking about. Nonsense all the way! So I just gave up and waited for another 2 months.

Just want to help you here! Try your best to get the LMO through. Meanwhile I suggest that you seek some professional advice for your kids.

Nevertheless, stay patient and strong. You'll get there.

No - you can't. You need an LMO/LMIA if you want to be able to start working again. There is no way of getting around this requirement.

No your not - must restore your status with LMO/LMIA
