Am I screwed - Please help all Experts please help

Hi All experts

I have submitted my application in October and got Aor as well.
It's been 2 months now. All of sudden I realized one thing.
In my passport my spouse name is mentioned as Anjali Gupta.
But In my spouse passport her name is still says Anjali Malhotra that is name before marriage.

Now my question is in my passport it says spouse as Anjali Gupta. But in her passport it says as Anjali Malhotra. Will this create any problem in my application process. If yes what is the way forward.

I have following solutions:

Solution 1 : Add endorsement in my passport that my spouse name can be read as Anjali Malhotra. problem with that is in my daughter passport mother name is mentioned as Anjali Gupta which again will be mismatch. Is it possible to endorse in passport to say that spouse name can be read as Anjali Gupta and Anjal malhotra

Solution 2 : Can i get notarized letter saying Anjali Gupta and Anjali Malhotra are same person somthing like this

Solution 3 : To change surname in my wife passport. But i am out of India and to get new passport processing time is 2 months. I am worried by that time my application may be rejected.

Solution 4 : To get letter from Indian Embassy stating Anjali Malhotra after marraige name is changed to Anjali Gupta. Not sure if embassy can do this

Please help I am really worried now

I would do everything to correct this to cic, go to embassy ask if they can issue a letter to explain the different in spouse last name. Go see a lawyer or notary to check with them what can be done at this stage ( probably would have to spend some $$ but you need a legal advice on this matter). call cic call center and ask them what can be done in such a scenario? they should be able to give you some info at least.... most of all don't wait do something as soon as you can

I guess you should be fine as her passport has not been reissued and it contains her old name. Both are her names (one before marriage, one post marriage and both are same person) and you must have declared both in the application i preassume. If i was you, i wouldnt worry.

Get an affidavit that explains the difference in name (like before marriage and after) and send it to CIC. I do not think this will lead to rejection of your application but still to do all from your end, please get the affidavit with explanation of various different forms of names.

I myself have issue with name as in some official documents, I have different names (same name but addition of my father name, spelling is different etc) in my Saudi Residency, Passport, bank statements, and I have successfully used the affidavit method to get SINP nomination and currently I have applied to CIC as well with the same.

Also, while applying, after ITA, you will need to list all names for the person and I hope you have done so for your wife?

I am going to Indian embassy tomorrow and will see if they can attest letter written by me saying before and after marriage name of my spouse.

Just a quick question what do you mean by declaring my wife name after ITA. in E-APR everywhere i have mentioned my wife name as before marriage name as all her certificate IELTS ECA has name before marriage. So leaving my daughter passport , my newly issued passport and my daughter birth certificate in which my wife after marriage name is mentioned. In rest all her old name is mentioned that is before marriage name.

I think as per requirement it is accepted to have different last name of spouse. You should just add a letter of explanation in your application to be on safer side. Indian affidavits n all dont hold much...you relax and prepare letter of explanation - point by point.

That one should include your wife's maiden name on it. Ask your relatives or friends in India to scan and mail it to your current address if you left it back home. Than raise a CSE, explain everything the way you did here, and upload the document.

while filling your ITA submission you should answer 'yes' for any other name used before. then CIC would have requested for a proof of name change. Now that you have not mentioned about name change send a CSE to CIC with below docs,

1) LOE
2) Affidavit from attorney stating both person are the same
3) Marriage Certificate ( i guess your name is Malhotra added to spouse after marriage)
4) Spouse old passport as Anjali Gupta (this is optional)

I went to Indian embassy and they have agreed to write in embassy letter head stating the following

This is to certify that Mr.Ashish Gupta holder of Indian passport number XXXX is married to Mrs.Anjali Malhotra holder of Indian passport number XXXX who is also referred as Mrs. Anjali Gupta.

Hope the above wording in Indiam embassy letter head will serve the purpose.

Please advise mssm if above letter will solve the purpose along with my LOE. I will get this on Tuesday and will raise CSE after that
