Am I eligible to extend work permit after 4 yrs.

Hi,

I'm going to complete my 4 years work permit by April'2014 and I had already applied PR but I may not be getting it by then. So please let me know if any of you aware of this situation and any option available for me to extend my work permit with same employer (or) any option to extend my work permit with PR reference number i.e AOR number.

Assuming you applied under the CEC program (which is what this area of the forum is about) then you can use the AOR to apply for a Bridging Open Work Permit (BOWP) when your existing Work Permit has less than four months left on it (so in December/January depending on the exact date it expires). The BOWP will be an open work permit and valid for one year.

If you're asking about the four-year limit for temporary workers (more info - http://www.cic.gc.ca/english/resources/manuals/bulletins/2013/ob523.asp) then I think you're safe, and you can just apply for the BOWP when your work permit is about to expire, if you haven't received PR yet.

The four-year limit only applies to work performed on or after April 1, 2011, and it appears that there is an exception for PR applicants who have received a positive eligibility decision anyway.

Thanks for the reply.

If I apply under BOWP then what about my wife. Which type of work permit I have to select for her. Currently my wife is in open work permit and my son is in Visitor status.

And if he wont get it within a year can he apply again for bowp?

Because the four-year limit has plenty of conditions you're better off reading the bulletin (http://www.cic.gc.ca/english/resources/manuals/bulletins/2013/ob523.asp) to see whether it will apply to you.

In any case, because the four-year limit only applies to work done after April 1, 2011, no one will reach the limit before April 1, 2015.

True about the limit starting in 2011; as well, If the OP applies for the BOWP, the four year limit does not apply - see the bulletin, this is in Group C, exceptions to the 4-year limit -

"Permanent Resident (PR) applicants who have received a positive selection decision or approval in principle in the PR category for which they have applied."

The principal applicant can apply for the Bridging open work permit. You can submit an application for your spouse's open work permit at the same time. It will not be a BOWP, but another spousal open work permit that is tied to your work permit (assuming she had one before).

By the way if I already holding wp since spet 11 till sept 14' I'm still eligible another one year, if I'm not apply PR than after four year wP finish than I have to go out and start zero or have to be out side cAnada for four year to eligible another 4 year permitt. Thank.

Yes, the relevant operational bulletin does allow for this but it is generally not expected as by the time you get AOR you are around 4-5 weeks into the process (current time lines), getting the BOWP takes around another month if you apply online (again, current time lines - I just got mine recently) and the entire PR process for CEC is estimated to take around 13 months at the moment.

As a result 12 months from the date when the BOWP is actually issued should be enough but if in the end it's not then you are able to apply for a new one as long as your PR application is still being processed.

The exact wording from the OB is here:

The open WP is to be valid for the duration of one year from the date of issuance. Although the PR application should normally be finalized within a year, subsequent requests from applicants to extend their stay on an open WP will be considered on a case-by-case basis.
