Hi i came to Canada in 2006 with my mom through business Visa. My dad has a convenience store which is doing very well ever since then. Ever since 2006 we applied for PR multiple times through consultants and failed each time. It has been 10 years i am in Canada i arrived here when i was 15 and now i am 25 . My dad is U.S citizen and he got scammed by immigration lawyer and we lost a lot of money during the process. My dad extends my visa every 2nd year for 2 years. I am not allowed to work on this visa and basically rely on my dad and his business. My question is Is it possible to apply for P.R if there is a family owned business ? Consultants tell me i need to get married . Is there any other way ?

your consultant is telling you get a marriage of convenience, i.e. get married primarily for the purpose of obtaining PR status. this is fraud and i'd suggest you look for a better consultant.

can you tell us exactly why you've been rejected in the past?

Thank you for quick response. My dad came to canada from U.S in 2005 under NAFTA and he bought a business and he applied for us for Canada. We arrived here and my dad applied under CEC Canadian Experience Category in Buffalo New york. I started going to high school. After 2 years later they sent us refusal letter saying my dad is self employed and cannot give job letter to himself. Then he tried to get job letter from different employer and tried to apply again and consultant told us that its too late and he cannot apply for family because i turned 19 and he said i no longer go under my parents guidance. I extend my visa every 2nd year for 2 years time limit and i am not allowed to work. Only progress i am seeing is my age.

It doesn't sound like you have any options for PR at this time - you certainly cannot be PR through your father's business. Your father was correctly refused under CEC - those your are self employed don't qualify.

I think your only option is to secure a full time job offer from an employer in Canada (NOT your father's business). That employer will have to obtain an approved LMIA so that you can then obtain a work permit. If the job you secure is in a skilled occupation (i.e. NOC A, B, 0) then you may qualify for PR after you have worked in Canada for at least a year (although there's no guarantee you will be selected).

Otherwise you need to leave Canada and obtain a few years of work experience outside of Canada before applying to return as an immigrant.

Do not enter into a marriage of convenience just to remain in Canada. If you do that, expect the fraud to be discovered. You'll then be forced to leave Canada and will end up with a five year ban from the country. Once this happens, it will be much more difficult to return in the future.

I know in the UK if you've lived there for 180 days every year for 14 years then you qualify to be a PR. Is there a similar thing in Canada? Perhaps you can check.

I'm not completely sure if there's such a law in Canada but there are plenty of immigration lawyers you can speak to online that are free. This page's administration for example.

You dad can try this and be able to bring sponsor you guys as well.

Self-employed persons are must have the experience, intention and ability to establish a business that will, at a minimum, create an employment opportunity for themselves and that will make a significant contribution to cultural activities or athletics in Canada; or purchase and manage a farm.

Yeah, especially when they could give you an exclusion order. Living so close to the border in Niagara would be terrible!

Hi,

Since you have completed High School there, apply for higher education and a student visa.
Complete your course, and then get Open Work Permit.
Work for few years and then apply under Express Entry where the processing time is just 6 months

No - there's nothing similar in Canada.

No and no.

First of all, he's too old to be sponsored by his father. Secondly, convenience store owners don't qualify under the self employed category.

How can i apply for student visa ? Am i eligible to apply for it since i am on stay visa ? Also i read somewhere that course has to be skilled trade related i.e plumber, electrician , welder
