Am I Eligible for Federal skilled worker program ??

Hi There !!

I just want to ask you guys whether my current condition eligible for Federal skilled worker program ?
1. I'm currently employed in Canada (ON) on LMO , NOC B
2. I went to school here in Canada for 1 year (post secondary program)
3. Has been working here for the past 2 years on PGWP, since it was expired last year I had to get a LMO to keep working.

and I'm wondering how long is the process to get approval with my current condition above ?

the problem is my PNP just recently got denied, and CEC wont work either because they my NOC code is no longer on their list. The only way to get a PR is the Federal skilled worker program.

Please I need your help to determine if I'm eligible with Federal skilled worker program, since I only have 2 years left to get my PR.

Your greatest enemy will be time as this present quota submission closes by April 30th.
No one knows for certain if they will open for this fiscal year 2014/2015 as they are still focused on the idea of having EOI in place by "early" 2015

Thus review below points and if you are confident you can have all the documents / requirement together in time and the cap has not been reached in your NOC code to file an application with CIO before April 30th, I say go for. It will help that you are already in Canada and shorten the delivery time from postage to getting to CIO

Well you don't need to worry much. You fall under Federal Skilled Worker Arranged Employment Category. Check the document checklist immediately and apply within next 1-2 days. You'll be considered in this category as your experience falls under Skilled Worker (Category B). But still you should have 1-yr of experience in this category.

If you have any questions, you can pm me and I'll let you know further details as I just submitted my PR application last week. Not sure if they'll accept it, but I've kept my fingers crossed!!

You'll need to include General IELTS results with your application and the test results cannot be older than 2 years.

Thanks guys for the answer, I'm still waiting for my police clearence and I have booked an english test later this Month. Hopefully I can complete my application mid May.

Do you know how long it takes for the PR process ? (in regard of my condition)

With AEO (FSW2) you can apply anytime.

Note you can submit even when all the PCC are not in yet, but need to have them ready when the VO will demand for it.

With you already in Canada, I assume your VO with be CPP-O and they have really been fast, noticed some people time line with CPP-O of 6months or less. This time line is not cast in stone but I think if all goes well you will probably be looking at 6 - 9months. Just my guess anyway.

Oh yes, I forgot to mention about IELTS. So don't wait for Police Clearance, keep you application ready and submit it as soon as you get your IELTS results delivered as you'll need original results sheet to submit with PR application.

I have one question to you "much_mann". Do you have any idea how long it is taking these days to receive PER and AOR these days? As I got to know, it's around 4-6 weeks for PER and 6-8 weeks for AOR. Correct me if I'm wrong.
Also can we apply for bridge open work permit just after receiving PER or one has to wait till you get AOR? My post grad open work permit is till only july 2014, so just 3 more months left now. So Kinda worried!!

You will have to look at the trend to make an educated guess for the timeline for PER & AOR, but the time frame you quoted is correct based on current fillers on the forum. AOR is dependent on the VO of course

After PER and if you meet other conditions, you can apply for the bridging open work permit, see below extract from OP6C ( page 19)

Bridging open work permit

Foreign nationals in Canada who have received a positive determination of eligibility decision under the Federal Skilled Worker Class, and whose current temporary resident work permit is due to expire, may require facilitation that enables them to maintain their status and continue working in Canada while they await a final decision on their application for permanent residence in the Federal Skilled Worker Class.

To be eligible for a bridging open work permit, an applicant under the Federal Skilled Worker Class must meet the following requirements:
1. They are currently in Canada;
2. They have valid status on a work permit that is due to expire within four months;
3. They have received a positive determination of eligibility decision on their application (i.e. the “Ministerial Instructions” status has be set to “Met” or a positive final determination of eligibility for processing letter has been sent); and
4. They have made an application for an open work permit.

If they are found eligible by the processing office, and there are no medical, criminal or security concerns, the foreign national will be issued an open work permit for a duration of one year from the date of issuance.

Note: Taking advantage of the bridging open work permit option has no impact on a skilled worker’s eligibility to earn points for arranged employment at the time of visa issuance. An applicant in the Federal Skilled Worker Class who has received a positive eligibility decision with an offer of arranged employment will not be found ineligible for points under R82(2) or permanent residence should they meet the criteria specified above and be issued a bridging open work permit. However, if the applicant’s choice to change employers results in the original employer withdrawing or no longer supporting the original offer of arranged employment, then the onus is on the applicant to satisfy an officer that they meet the arranged employment requirement with their new employer (i.e., NOC 0, A or B occupation, new LMO and new qualifying offer of employment).
