I spoke to the same agency again today, and below was the thoughts why he thinks my case would be rejected.

Depends on who you ask, alot of in-experienced consults may tell you yes because people ignore the employment requirements of the applicant for certain job. It's not all about whether the title is O A B, and its about if you meet the job qualification as well. As i told you last time, if you study graphic design, you cant apply under accounting technician even if it meets NOC code, so you have to assess yourself according to the requirement i listed you for process operator.


Basally what this agency saying was that its very risky to apply CEC under petroleum process operator because i have no education background on this field.

CIC 9232 Employment requirements:

Completion of secondary school is required. Mathematics, chemistry and physics subjects are often specified. (Met. I've got business management diploma in college)

A college diploma in process operation, sciences or a related subject may be required for some positions. (Not met)

Petroleum and chemical process operators and process technicians require completion of several years of formal company training. (Not met. It is my first full-time job in Canada)

Experience as a petroleum or chemical process operator in all the operating units controlled by the central control room is required for chief operators. (Not applied to my case)

Company certification as a petroleum process operator or technician may be required. (Met. I have been signed off as a petroleum process operator )

A provincial stationary engineer licence, compressor operator or refrigeration certificate may be required when certain kinds of equipment are included in the process. ((Met? I've got Alberta Petroleum mechanic helper certificate)

Certification in the transportation of dangerous goods (TDG), first aid, firefighting, or workplace hazardous materials information system (WHMIS) may be required. (Met. I went through all these trainings.)







What do you guys think???? plz comment!!

I would say that consultant is trying to extract money from you.

The act requires that your work experience be skilled. I agree, to some extent, that if your NOC Code has specific educational requirements, it would help the officer assess the NOC Code to your duties. However the primary factor is that your duties match the NOC code.

A college diploma in process operation, sciences or a related subject may be required for some positions. (Not met)
Note the wording "may" - it is not regulated or required.

All of the required (per HRSDC) educational criteria have been met per the NOC listing. If you're concerned about the education mismatch, you can consider including a letter stating your training for the job, and include copies of the internal certificates and evidence of training you completed during your job.

See all duty descriptions on page 1... I think its a perfect match..

Yes I belive U have very strong case and eligiable to apply for PR under CEC...
Secondly I would suggest you to go for free assesment on canadavisa.com. Mr. david cohen is expert person he will assist you . But I am quite sure You are eligiable ...
Even i am working as a Cook but my background is IT so i talk to Mr. Cohen and he told me that CEC do not look for Education Background they Just need 1 year Experience in any of NOC A, B or O with 2 year of study from recognize institute. IELTS Score is must.

Please read SECTION 6.1 of the link I am sending you it clearly state that " the applicant does not need to meet the “Employment Requirements” for the particular NOC to receive credit for work experience under the given occupation".

The work experience does not need to be related to the Canadian education.

I have a question too about my situation. All my papers for cec application is done and complete already i have a 1 year experience to the company. but im thinking if im gonna submit it or not my workpermit just renew this february and will expire on 2015 but the problem is i quit on my job. My question is can i still submit my papers? Do you think my application will gonna cause a refusal coz im now unemployed? Pls i need help.,,

Once you worked for the year and can get the necessary reference letters, you don't need to be working in that job currently. You should be eligible, assuming you have the right experience.

No, there is no requirement to stay with your employer or be employed, or even remain in Canada, while your application is being processed.

here is what he replied:

yes. thats what the web says; however, Im telling you based on experience. alot of cases rejected because they dun think its reasonable or the applicant is obviously unable to handle this job. And personally i do not think it makes sense if someone obviously doesnt qualify for such job n it gets approval. Logic and reason is the key to the overall success. So i told you it doesnt mean u gonna fail but the risk is much higher

To be honest, your consultant is just trying to scare you into handing him money. The CIC is strict, but not unreasonable. Everyday people change jobs (different from their education) due to changing interests. If the job was regulated (i.e. doctors, nurses), then I would agree with his statement. However, for other types of jobs, that don't require specific education and that you can receive on the job training (which you did), this is completely within the realm of reason.

It clearly say that "There are no restrictions on the type
of work you can do or where you do it, but to qualify
for the CEC, remember that at least one year of your
work experience must be skilled work experience."
