Hello,

Evn the esdc is not explaining me prperly abt motorium!! I am international student n i am wrking as retail sales supervisor, the prob here is my wp is expiring nxt month n my employer agreed to apply for LMO for my postision but prob here is "evrybody is saying the motorium is affected to food sector only" but if u see in motorium NOC 2006, retail trade superviosr "6211" also come under tht!!! I dnt knw if my lmo vl be positive or vl be on hold. Does it makes any difference for me bec i am on my open work permit n i am not TWF.

Can anybody let me knw wht would be fair enough to do now? Its very hard in canada to find a good job!!! If i quit this job, i dnt any more wp to find another job!!

Hi, sujani,

I don't think the new regulations will affect you. I believe the changes to the tfw program will primarily affect foreign workers in the food service sector... however, I'm certainly no expert.

May I ask how you managed to get an open work permit if you're an international student...I thought students could only obtain an off-campus work permit?

hi, sorry i think i dint provide much information, i completed my studies and got my open work permit like anybody else. I am stil in confusion for this motorium. hope so good news ahead.

It doesn't matter on what kind of visa you are right now. That NOC code is affected by moratorium so unfortunately you won't get approval for your LMO.

As you said, you will have to find a different job which is not affected by moratorium. Since you have only one month left I advice you to find an employer with pre-approved LMO.

That's not entirely true, the NOC code is on the list but only for employers in the Food Services sector, so if the employer is not on that sector, they'll be fine. Also the moratorium is expected to be lifted in the next few hours.

Yes, the moratorium has now been lifted, but the whole foreign worker program has been changed quite a bit.

Well, motorium is lifted now...my employer agreed to give me a preapproved lmo bec i cant wait for new lmo to be processed bec it could take month n added to tht my OWP is also expriing nxt month!!
My question is my employer is going to send preapproved lmo with my name on it!! So whn vl able to get approval!
And also do i need to wait for tht approval to apply for new wp bec mine is expiring on 16july, 2014!! So how many weeks its going to take for my lmo to be approved n shuld i apply for a extension now without this lmo approval so tht i dnt be out of my status in canada...

Anybody can help me out!!

I am very confused of what you are trying to asked. Let me clear some things first for me and others to understand: is your employer already had a pre-approved named LMO ( with your name)? If yes then you can apply for your work permit with that LMO. If you mean your employer will be sending an application for your LMO, which by the way will be LMIA now, then you need to wait until your LMIA get approved. You still have 90 days to restore your status after your work permit expires and hopefully by then you get your new LMIA.

NO... all LMO's that will have positive results, pre -approved and not expired are now unsuspended as the moaratoruim lifted and will processed to the CIC...

I don' t know whether pre-approved (unnamed) LMOs are still valid... CIC says they will accept pre-approved NAMED LMOs...

You can apply to extend your work permit within the 2 weeks preceding the expiry date, if your employer has applied for the LMO but you have not yet received a response. In this case, you would be on implied status (as long as you apply BEFORE the WP expires). CIC will wait 2 months - if there is no LMIA by then, it will be refused.

thanks for your time!!! can u tel me how do i apply for work permit, vl it vl be general work permit application? i mean how shuld i go ahead with applying for my extension of work permit? if you can send me a link that would be of great help to me!! :)

is it is better to apply online or paper application? and in the mean while if i get my preapproved lmo with positive response thn how shuld i let cic know that i have lmo? and vl they process wp fast by thn?
