Already working in Canada open work permit - need LMIA

Hello to the community

I couldn't find the information so let me explain

Here is my situation.

I have been working in Canada for the past 5 months on a 2-year open work permit (International Experience Canada).

I would like to apply to become permanent resident - express entry. I got 455 CRS point which is currently not enough.

I realized that getting an LMIA from my current company would help me to get an extra 50 points which will definitely help me.

To proceed the LMIA my company need to advertise the job on a job bank. I am wondering, since I already occupying the job, does it still make sense for the company to advertize this position as they are not looking to hire someone else? I can still legally work on that position for 1 and half year.

If your employer wants to apply for an LMIA, it's mandatory that they advertise your job on Job Bank and two other places that meet the LMIA advertising requirement. No advertising will result in an automatic refusal. The point of an LMIA is to prove that your employer has advertised the role and attempted to find a Canadian for the role. They need to prove they were unable to find someone and therefore have to hire a foreign worker.

I dont see whats the rush of you boosting your score immediately.
Firstly, what is the corresponding NOC job you are working for? Check if its 0,A or B, if it's , once you worked for 1 year, you will get additional CRS pts.
By then, you score should be higher than the cutoff score.
Lets say you do not want to wait for 7 months before getting invited, the process of LMIA takes time. Your employer has to advertise your position through jobbank for 1 months. The application itself will take about a month before decision is made. I have also heard that the approval rate of LMIA is really low unless your job is a very technical job and a high demand job.

NOC job is 0 so I will definitely get more points after 1 year of work in Canada.
The rush to boost my score is that with my current visa I cannot get my wife and my kids to immigrate to Canada yet.

If you would like to proceed with the LMIA application, talk to your employer and see what he/she can do. Otherwise, you may have to just wait

Keep in mind that 1.5 million people last week applied for unemployment benefits, aka they do not have a job . You advertise that position right now as available, more than likely an eligible Canadian will apply
Which could mean the employer has to hire a Canadian for the position, and you , a foreign national on a work permit , could potentially be out of a job
