How did your husband get his PR?
When did he land (activate his PR) in Canada?
When were you married?
They called for interview(6/2019) for him before he get pr there for updates in profile.
At that time he didn’t mention our marrital stats thinking of it gets reflects late in the profile of him .

If he didn’t include you in his application and landed as single when he was in fact actually married, you have a difficult time ahead of you. You would not be considered as a family member/ spouse. He has also committed misrepresentation by omitting information relevant to the visa officers decision. You can appeal, but it’s doubtful they would find in your favour. You need to find yourself an immigration lawyer (not a consultant) well versed in immigration law.

Really it’s impossible for anyone to really say if it will succeed or not. Based on previous posts and cases, the courts have generally held up IRCC position that if a spouse isn’t declared or medically examined prior during the application process, they don’t qualify as a spouse or family member. Expect a long and difficult road ahead of you.

We applied our(mine) application on june and we got married in dec 2018
If he failed to add you to his application and got PR as a single person, then he can never sponsor you. An appeal will not be successful unfortunately.

Anyway, normally, they should request additional documents from Mississauga office. We have all been waiting since we won our appeal and no movement,

Yes our hearing was on january 15 2020 and we get the court decision may 2020.
We got decision on May as well. I have tried calling my case manger, left the voicemail and didn't get any response.
GCkey still showed application is completed and refused.

Subsection 5(b)(i) of the immigration and refugee protection regulations states that for the purpose of these regulations ,a foreign national shall not be considered

(B) the spouse of a person if
(i) the foreign national or the person was,at the time of thier marriage , the spouse of another person
