So can anybody please help me to what should be my next step and how ???

don't make assumptions. It could be very much that they extended your medical and will be sending you passport request.

its been a long time since i have been on this forum. i had my appeal hearing jan 14, 2015 but still no response yet..im afraid that they will refuse. i called a few weeks back and the lady who answered my call from the immg division after giving her my case number said that the judge is still working on a decision. is this normal. i thought the decision should have been within 3 months. please feedback anyone...

I did not hire a laywer and its my first marriage.

No one knows your case better than you do.

Do you remember, when you filled and sent the appeal application to IAD, did you send any other documents/proof with it?? Did you specifically request for an ADR??

My lawyer sent the appeal application along with a letter requesting ADR and many other documents/proofs etc. Those were all returned after 4 months because my lawyer didn't add the serial numbers on those pages.
He had to send the same stuff again after adding the serial numbers. Wasted 4 months of my life.

I read all of your history. You have waited for so long now. Did you go to an ADR or was it a full court hearing? I was under the impression an answer from the ADR was almost immediate.

I can understand why your case is taking so long ... but still they could have told you about the warrant right away rather than making you wait 2 years to have an interview and tell you they could not look at the case! No doubt the system is broken.

But there are so many questions about your husband's activities. To me, it seems suspicious that he dropped his request for refugee status. Many people have tried to immigrate to Canada falsely claiming refugee status. I am not saying your husband did this but I am sure that really pisses off the visa officers. And then later you mention he had drug abuse issues. And the claim he left Canada within 15 days ... I was not clear if there was proof of this.

All of these things would make your case take a very long time. Is it 6 years now? Does your lawyer have any idea why it is taking the judge such a long time?

I hope the judge clears your case. If she does, then your file will go back in the queue and then they can only question the paperwork ... no more questions about the refugee status, etc. If she does not clear the case then you can go to judicial review ... there may still be options.

I also hope that when your husband joins you, whether here or in Pakistan, that he works hard to support you and your children! He should be grateful for all you have gone through for him.

I filed my application for appeal in Oct 2014 and rec'd my date for hearing in Jan 2015. ADR was held in April 2015.
I did not specifically request ADR


I send my documentation and proof after i had rec'd my date for hearing not at the time of the application.

Of course, the proof and documentation should be well organised and labelled - along the file number.

As i said before no one knows your case better than you do.

If you're asked to send prepaid envelope then send it, I was asked to send prepaid envelope and I sent it since last dec , now my status Change to dm, I'm waiting on my package , good luck
