Red flags are different for every case, and probably for every Visa Officer. Most of these are things that you can't change now. Sometimes things like:
- getting married at a registry or private ceremony
- both families not attend wedding
- informal reception
- no honeymoon
- no kissing on the lips or other displays of affection in photos
- different levels of education
- sponsored someone else in the past
- applicant applied to get into Canada in the past
- discrepancies with previous applications
- etc, etc., etc

Hey I hv same red flag few of them like bth families not attending the marriage
No honeymoon
Sponsored someone else in d past
Applicant applied study visa in d past but rejected
Dat means if I hv these red flags m having very low chances to win the appeal? Plz share

Congrats! I can well imagine what you might have gone through after getting that misleading message from IRCC. Anyway finally the ordeal is over. Have a blessed life in Canada together!

Not necessarily. Just indicators that they look for when assessing whether a marriage is genuine. Too many of those, and you get called in for an interview to explain. If not satisfied, they will refuse the application, and give you the option to appeal the decision. What does it say in your BB notes? They will document the concerns for your particular case. In your appeal, you have a chance to prove your marriage is genuine, and the applicant's primary purpose is not to emigrate to Canada.

Other potential red flags:
- age difference
- not spend enough time together
- no proof of financial support
- no proof of continuing contact
- no studio wedding photos
- only studio wedding photos
- not visit enough of each other's family and friends
- no future plans together
- any kind of misrepresentation, or perceived misrepresentation

You need to look at your own case objectively and see what may raise an eyebrow. You need to engage the help of a third party if you can't look at it from a distance.

We had proof for all of what you state as red flags and was still denied after the interview. We appealed and now have an ADR so as someone stated on here a lot of what the Agent thinks and how the answers at the interview are preceived by the agent will determine the outcome. Best policy is to be well prepared no matter what

Yes. Many people here have commented that the Visa Officer already made up their mind before the interview ... I guess they would have, otherwise there wouldn't be an interview. What the VO considers proof, or sufficient proof, and what you think is proof are two different things. The interview was the applicant's chance to convince her/him otherwise, which is not easy when they already made up their mind. Also most times, it seems they refuse to look at any additional proof that you bring to the interview.

It's sad to see so many families put through years of nightmare just because one person might be having a bad day, or have some biases. Same with the Minister's Counsel during ADR and Appeal - they have no requirement to be objective, or have an open mind. They are there to defend their decision.

This list probably belongs in the Application Forum, as it's things that I wish I knew before we even applied, or in some cases, even married. A couple more to add:

- married too soon after meeting
- photos seemed staged
- people don't seem happy enough

Also, if any proof is missing from your BB, make sure you include it in the proof for the ADR or Hearing along with any new proof. What is in the BB is all that IAD has to go by to see whether you qualify for ADR, etc.

my lawyer sent new evidence along with a letter saying their decision isnt right .
anyone else did the same and got any good result or not ?

If you read through the old posts, some people had good results, and others not.

Every case is different, and it depends on the strength of your new evidence. Your lawyer is better able to answer this question for you. What did she/he say when reviewing your additional evidence? Did he/she groan and make clicking sounds with his tongue and shake her/his head slowly?

By good result, you mean to get an ADR?

after seeing the whole thing, my lawyer said its a stupid mistake by there side.its not something big to get refused for
he said i had enough evidence and said he will explain them everything .
by good result i mean if its possible to get a fast result.

Hi friends need advise

I got refusal in spouse sponsership file new delhi.
after getting advise from all. I decided to do a new application.

Are they going to return my old application file?
Because my all original proofs like hotels bill, restaurant bills, honeymoon details and proofs , movie tickets, and all proofs of me and my wife are in file.

This is where I am worried because in new application I have to submit all this documents as proof of our relationship again.

Please help me out

If it's something that is easy to clear up, then it will probably go to ADR. ADR is the fast-track for anything that requires less than 1 hour to resolved. Your lawyer should be advising you on the process, and what to expect. Good luck. Hope you are spared the long wait that most of us had to endure.

In our case, they returned all the original evidence at the interview, when they refused us. You probably should have just sent copies, and said originals are available upon request - except for the few documents where they say originals are required.

Hi Hema,
When u re apply,mentioning old file no,copy of old cover note and attached all copy of ur proof and mention that all original proof attached with old application.U hv keep all records of old file.u hv not worry.God always with genuine case.
