Thank you for the reply, I really appreciate your time and concern but I have an other question if you can help me. I did send the request for the appeal within the 30 days, so can I request my appeal to go in vancouver in order to save some time?My husband lives in toronto but he can travel to vancouver for the interview. Question? IF we also can apply for babysitting program while I am waiting for the appeal? Because I lost hopes on the appeal and so stressed to wait so many months and nothing good.

Help is appreciated
I dont think you can schedule in Vancouver but im not sure about this. Maybe someone here knows this question. Waiting is the hardest part. Best to keep busy and most important....NEVER GIVE UP HOPE ! :D

Hi, I was wondering if it is possible to file an appeal through Vancouver even if it's not my location as long as I retain counsel from there?

Does anyone know if you are forced to go through a location in your area? I'm wondering because of the timelines that I see.

How long did it take you to receive order from IAD after winning your appeal? Looks like we both receives it my lawyer and myself and everything else such as ppc request etc goes to my husband.
Also did your/anyone case went back to original visa post or was it processed in Ottawa? How did it take to finish whole processing?

Thanks

Hi everyone!

Good news. I just received in the mail a letter confirming I was granted an ADR hearing!

Does anyone know how long after you receive this letter that you normally hear from someone to schedule the date?

As well as is it possible to win alone? What should I be preparing for? And what things would you recommend sending in...

I am feeling a bit relieved and hoping everything works out. All advice is welcome and appreciated!!!

I would appreciate if any one knows to let us know because I like to know that too. Is better for us to move the appeal case in a place that saves us some time.. help please

I did not have a formal wedding which made them think may be its not genuine wedding. Honestly I do not disagree with the officer's decision 100% however, she should have given me a chance to explain my self. Also, should not have scared my husband so much during the interview. But any how I know I had to wait so long but eventually its all sorted.
So sad. Sorry to hear. Hopefully, from your side everything went good. Happy for you. Glad everything your case is successful. :p :p :p :p :p :p :p :p :p :p :p :p :p :D :D :D :D :D

You told you did all by yourself. How much is the fees for ADR? I already paid $1000 to appeal for ADR. After date comes the lawyer told to pay about $2000 fees. Is that true?

What do you mean by fees? there is no fees for ADR or appeal or any of this. The fees he is talking about its his fees lol he can charge as much as he wants. I paid about 2100 for the whole thing. But now once I won ADR he wants more money and I don't think I am going to pay him more.

I never got a letter straight ADR date after blue book. It is definitely possible to win by your self. During ADR your lawyer is not allow to speak any way. However, you do have to submit proves 10 days prior to your hearing with a good cover letter. If you think u can handle that I would recommend you not to hire a lawyer. What is the reason of your rejection, your submission should be accordingly.

Thanks

I am not sure what are you asking? Blue book should have pages where there should be interview notes and officers complains etc. Try to read every page, this blue book has everything your case was rejected for.

I feel confident enough in the evidence I have, and how long we have been together that I can do it on my own. I am just wondering what exactly should I be sending? Like recent photos, letters, mail, boarding passes, etc? I am just concerned on what it is they would like me to send. Did you receive a date quickly after you got your letter?

We were rejected based on non genuineness of relationship. It was a very odd rejection for us as we were married for two years before submitting our sponsorship (we have been together for four years now, five in December). They also said we did not share a common language (I myself am Chilean-Canadian and my husband is Cuban, so in fact we do) and that my husband was no longer working (he was a teacher in a school based around the communist government, marrying someone out of a non-communist country he wasn't able to work in his profession anymore).

I would prefer not to hire a lawyer and do it myself... However I feel very uneducated on what I will need to send in for my ADR hearing, and what I should be prepared for during the ADR.

Thank you for your reply!

Hello Received the immigration file of for my wife on Tuesday still reviewing it , it's much smaller than expected
Applied March 2013 - CIC Mississauga
Approved to sponsor May 2013 - Mississauga
PR interview for my wife was nov 2013 - Singapore
Got a decision Feb 28th ( so much for their 2-3 weeks from interview date) -Singapore
PR Denied
Application for Appeal filed March 10 2014
Received notice of appeal April 1 2014
Received certified copy of immigration record Aug 5 2014

I must say I'm impressed that these people (at least the interviewer my wife had) have the audacity to complain about immigrants English skills when they don't seem to have even high school level English.
Reading though the file I noticed that although we submitted about 50 pictures to our immigration "consultant" keeps referring to himself as a lawyer contrary to what IAD calls him. The file includes 5 pictures from our wedding, written statements from my wife and me in regards to the origination of our relationship, copies of my passport but not my wife's, copies of original and translated copies of marriage, name change documents and birth certificate for our daughter (my step daughter), copies of divorce paperwork from her first and 2nd husband, translation of our wedding invitation (no copy of original) copies of phone bills and joint credit card statements and 4 pages of 800 that we submitted..

I'm curious if anyone else has received less in their file than was submitted?

I had to reparse the interviewers notes as it was mostly unreadable, presented as a continuous run on sentence with no grammar or punctuation.

For some reason they lacked ability to read and have her ex husband listed as my friend in the notes.....I knew of him (not right away) never met him; clearly stated in letter that I didn't know him.
Lists that we "claim" to have a miscarried baby I know we submitted the medical record for the hospital visit translated in English.
2 TRV refusals- First time due to lack of supporting documents also that she was going to visit my sister as although I had sent my wife an invitation letter at the time one of her friends insisted that it not be sent and that she shouldn't be applying for TRV to see me, (also supported by the lug heads at immigration Canada as per I quote "when you apply it would be best for her to visit a family member of the same gender as it will be denied due to suspicion that she is coming to illegally stay in Canada if she lists you as the reason for her visit")
2nd TRV refusal we sent lots of supporting documents daughter in Thailand not joining on the trip land in Thailand family in Thailand money in Thailand, but as per the stupid pdf form not having an option for Fiancé only spouse or friend we opted to select friend as we weren't married yet. this is listed as an note with multiple !!!! as I was listed as a friend. For whatever reason we were unable to satisfy the VO no reason given just that we didn't satisfy her.

Onto the interview my wife requested an interpreter as she didn't want any confusion answering questions, this was taken as she can't speak English my wife is nervous speaking to new people in English.
Next concern was her previous marriage it was in for the most part a marriage of convenience for him more than her he was primarily looking for a housekeeper/caregiver he could marry so he could retire to Thailand, in exchange he took care of her and her family financially. She was unable to live under those conditions leading to divorce from him (we started seeing each other before the divorce)
Their hung up on her previous marriages 1st one I don't see as an issue was a shotgun wedding because she got pregnant -> Thai do have a habit of trying to save face , marriage ended because there was nothing in it for her. I understand their concern with the 2nd marriage but if she really wanted a sham marriage for convenience she would have stayed with him he made 10x what I do annually literally (near $400k a year)
The next item in (!!!!Sponsor is 5 years younger!!!!))) they did note that my wife brought some more pictures and several thousand pages of Skype/Tango conversations all in English. clearly her English skills are limited and it is impossibly for her and me to have any meaningful conversation limiting the credibility of a strong husband and wife relationship.
When asked my wife said she loved me and unlike her other husbands I help her with everything cooking cleaning listening to her and her family likes me a lot despite the fact that I'm a poor working shlub when asked about her first husband he was a bum who wouldn't work who didn't like her family, her second husband treated her like a maid and never listened to her or helped her (other than financially)

Interviewer notes : it is Clearly an attempt to enter into a marriage of convenience strictly to enter Canada as there are pre-existing pulls for her to do this.

To me it seems that the interviewer had already decided before my wife got there to reject the application.

If there is some feedback I'd love to hear some suggestions perhaps from people who have gone though a similar situation.
I have yet to receive a date to see ADR or Court.

Documents I'm rounding up right now
English assessment for my wife -> trying to find out who would be acceptable to handle this
statements of our joint savings account in Thailand
letters from family and friends
More photo's
copies of Skype and tango conversations,
Paypal money transfers
All tickets and receipts originating around our relationship

is there anything else anyone could suggest?
I'd ask my consultant but even though he sent a copy of his intent to IAD to consult at no charge he just emailed me telling me he wants 2500 in 2 payments for consultation
You should not write such a long email, it took me 2 days to read it lol

1- You do have some things that are going against you in your case, right? I hope you understand that so I am assuming her not speaking proper English is an issue because you both have diff mother language? I am asking this because my husband asked for a translator during the interview but they did not pick on that however, we both speak same mother language.

2- This is her 2nd marriage and yours first? and you are also 5 years younger than her. - you will have to be prepared with very logical answers as to why did you not marry some one younger or at least same age as you and with first marriage. This does not seem normal to them.

Documents:

all of the above you mentioned including below if makes sense to you:
1- Your letter of employment that mentions her as your wife, RRSP and benefits that shows her as your spouse.
2- Marriage certificate translated if required
3- If some how possible to show how many Thai women have bad marriages and they leave their husband or the husbands treats them like slaves etc. How hard for them to survive etc and commonly they do 2nd marriage like news clippings, some articles etc. New paper name and date should show.
4- Verification of your marriage from the church or where ever you got married
5- entry and exit stamps on your passport for all visits, boarding passes

Thanks

Some examples of documents:

1- okay first things first why did you wait 2 years to apply for the sponsorship? Did you not want him to be with you as soon as possible ? be prepared with this answer
2- Your letter of employment that mentions your spouse, RRSP and benefits that shows your spouse.
3- Marriage certificate translated if required
4- Verification of your marriage from the church or where ever you got married
5- entry and exit stamps on your passport for all visits
6- boarding passes
7- His current work employment to show that he is working or have been
8- letter from friends and family (they know about your marriage and your relationship etc)
9- Money transfers recipes
10- pictures
11- proof of communication
12 - gifts and outing receipts

remember everything about him his work, his family brother sister names, friends names, time periods you stayed there, dates, why did you marry him ?, your relationship with his family, his relationship with your family, where do you work etc, basically everything about him and you and your relationship.

Thanks
