Hello,

My husband and I are waiting for our appeal decision.
My spousal sponsorship application was refused on April 1, 2022. I filed for the appeal right away. We had our virtual hearing with IAD on March 9, 2023 and we are still waiting for our appeal decision.

Our spousal sponsorship application was refused due to misrepresentation, sections 16 (1) and 40.
Does anyone know how long it will take to get our appeal decision? It has been two months since our virtual hearing. Does anyone know the chances for our appeal to be approved?

What is the expected process and timeframe after my appeal was allowed- PR family class -conjugal partner -sponsorship? Refused in September 2023. Appeal allowed March 2024.

My application is 6 years old and I have just gotten a 5 years ban for misrepresentation.
I failed to declare that I use to live in the USA and I was offered a PFL letter which I responded to.They noticed acknowledgment of the response and asked me for an FBI police certificate that I provided.Now they are refusing my application and they give me an option to appeal in 30 days.
Could I have a chance to win the appeal?
What lawyer do you recommend?
It’s Québec application.

I understand your frustration. I went through the same when I sponsored my wife and we got rejeted. I appealed the decision and built a very strong evidence book and represented my self in court without a lawyer. Gather as much evidence you can, whatsapp/viber messages or calls. Letters from family members. Pictures, receipts of vacation if you did any etc, Anything you can think of to help your case. I presented my whole life to them from the moment I met my wife.

Thanks for the reply.The thing is that they are not questioning the genuineness of my relationship.They are accusing me for failing to declare that I have been in the states...
They hold my application for 6 years ,and now they are rejecting it even though they did not find anything fishy on my PCC.

I doubt you will be able to overcome the 5-year ban. Not declaring you lived in another country is a big deal.

Thanks for your response.So may be I will not hire a lawyer and let my sponsor file for an appeal and reresent herself.That way if we fail to overturn it,we will not loose the lawyer money.

I'm no lawyer, so please don't take my post as advice. I just believe you are very unlikely to overcome the ban.

If you have a misrepresentation ban then you definitely needs to hire an immigration lawyer to try to overturn it. This is generally extremely difficult to do. It sounds like the misrepresentation ban was correctly applied in your case so the chances of success are likely going to be close to nil. Sorry. Good luck.

If you have a misrepresentation ban then you definitely needs to hire an immigration lawyer to try to overturn it. This is generally extremely difficult to do.
