What is the timeline after getting Medical done for Supervisa (TRV) ? and what are the chances of rejection even if Medical is good.

I just want to know that I intend to visit USA in July 2015. I want to visit Canada (Toronto City) from there. Can I apply from Pakistan for Canada. What documents should I submit. What are the requirements. Your help will be much appropriated. Thanks

Hi FKL and senior members,

Please need your help here,

I am studying here in Ontario in Masters program, have completed 2 semesters and only left with one semester. These days I am completing my Co-Op work term which will end in August-2015, so my last education semester will be from Sep. to Dec-2015. I came here in April-2014, and its been year here, I applied for visit visa of my wife and kid back in Dec-14 (refused, No travel history, Purpose of visit and Financial status), applied again for visit visa in Feb-2015, refused again( Travel history and family ties in Canada and home country).

I want my wife and kid here, as per my research, I have only left two options, either wait for my studies to complete and then apply for PNP in Jan-2016 and then apply for PR (Almost 2 years from now).

Or I apply for Open work permit for her and visit visa for my son (1.5 years old). Please guide me what option should I choose to bring her here as soon as possible?

When I applied for her visit visa Feb-2015 (this month), I attached following supporting documents other then CIC forms,

1. My Co-op job letter with 2 months salary slips,
2. My university enrollment letter with my transcript
3. Rent receipts for my house with bank statement.
4. Notarized invitation letter stating that I will provide food and home during her stay, and that I am also going back home after my studies compete, so there is no point for her to stay here when I am also going back.
5. I bought full medical insurance for my wife and kid, attached original letter with visa application

She attached following documents with her application

1. Leave letter from her employer for 2 months
2. Property documents and an affidavit letter from her father that she look after all the property matters and he is going to transfer this property to her name.
3. She purchased return ticket, and attached original ticket with receipts
4. A letter from her side explaining the previous reasons of rejection (Travel history, financial status, purpose of visit) and telling them our wedding anniversary is coming in March, and we want to celebrate it together.
5. Copies of her educational documents.
6. Notarized letter from her uncle, guaranteeing that she will keep her promise and will return back home before expiry of her visa.
7. Bank statement for previous 6 months amount to 15 lacs = C$17,000

In short we were damn sure that this time it will be success, she applied paper based application on 2-Feb-15 and got refusal on 17-Feb-15.

My question is, when should I apply for her Open work permit and what else documents can I attach with it? Please help me in this case, It will be really nice of you.

@B4Ahmad, rather than speculating on reasons, you should apply for gcms notes to get the concrete grounds of refusal.

I presume your university and program is in good reputation with CIC.

Hey Fahad,
I think in this Visit visa suits your dad..but he has to show full intention that he would go back ..(bank account, job or home proof)

Hi FKL,

I did apply for GCMS notes firs time, and there was nothing mentioned, same reasons in GCMS notes as were in rejection letter (Travel history, Purpose of visit and financial status). There was no comments by VO, so what else can I deduce from there?

My program is M.Eng electrical @ University of Windsor, and before that I have 5 years of experience in multinational companies back home in Pakistan.

I am shocked with these two refusals. You have always recommended to go with Open work permit for spouse, If I apply now, what should I attach with that application, and any success chances? I am also considering applying online this time.

Quick question - Today I got email from VSF Global saying that my mothers processed passport has been dispatched from Canada Visa Office Islamabad. The question is will it be available for collection tomorrow i.e Friday or i need to wait till Monday ?

That seems weird since all you mentioned seems okay. Yes i would recommend applying for open work permit. Did you try applying for a regular TRV for a short visit i.e. without medicals? Or did you state the intent of living in Canada for as long as your (principal applicant's) permit is valid?

Yes i always recommend SOWP because it gives no impression of short visit and clearly states the intent to live in Canada with principal applicant for as long as he is there, even if one doesn't intent to work. Also with SOWP you also attach applicant's educational credentials, job experiences if any etc. So the overall picture turns out much better and increases chances of approval.

I might look into the description you wrote before again to see if i missed any thing - with in a day and let you know if i see something different.

But its not a good idea to apply for SOWP when your permit is going to expire soon unless you have a PR application in process as well including the same spouse.

Since my last semester of study is starting in September, I am going to renew my study permit first in April and probably I will get extension until June-2016. Just after getting my study permit, I am going to apply for my wife open work permit in May or June this year. There is one speculation that because of Pan Am games, they are not issuing visas, may be this could be the reason for rejection.

We requested for 2 months time for visa, and mentioned that its our wedding anniversary and we want to celebrate it together. There was no medical requirement for that visa. Regular TRV for wife and kid.

Can you please guide me,
1. What other supporting docs should I prepare for her SOWP now? or Can I use the old one, like property documents etc?
2. For How much duration should I apply the OWP?
3. Importantly, Can I apply online from here on her behalf, I will get letter from her stating she is nominating me to apply and collect all data.
4. I want to go to Pakistan in this May to see my wife and kid and I am planning to come back around 20-May-15, but my TRV is expiring on 5-August, so when I come back, will it be ok at airport, because of visa would be expiring within 70 days at that time? Please guide me on this (I am trying to get my Study permit renew before departure, but TRV renewal takes lot of time and I had to sent passport that is why I am hesitated and plan to get TRV after coming back).

You are most welcome.

That's where i see the blunder. "2 months for visa - short visit for wedding anniversary".

Even if that is your genuine intention i have seen it refused ALWAYS without exception. You see if some one is studying or working in Canada, it is quite unreasonable to believe his/her spouse and kids want to visit for a short time. You don't intent to visit your spouse, you most likely intend to live with him / her for as long as they are there.

I am not saying this is a fair assumption but unfortunately it is really hard to prove this and is only granted if you have really strong other grounds.

Even if you don't apply for SO work permit, you apply for a resident trv. Basically there is no difference in the application process EXCEPT that you INDICATE your intention for living with your spouse for as long as he / she is there. You get call for medicals, and processing time is the same as that of work permits.

But once you get trv and land, you get a "visitor record". So your kid can go to school based upon a "TRV with visitor record", your spouse and kid can get health cards after completing the waiting period depending upon province and there is no condition for max stay of six months. Rather it is valid for as long as you are there.

1. Nothing specially new in docs. The refusal is caused by what i mentioned above for sure. Just state clear intent of staying with you as long as you are there along with what you submitted earlier.
2. You apply for SOWP for as long as you are there. It is common sense. You want them to live with you for as long as you are there.
3. No you cannot apply on her behalf. Unless you put application online where there is no way of knowing you filled forms for her. Still online application will be processed at embassy catering her country of residence and corresponding processing time would apply (Islamabad).

4. No concerns about trv expiring even if there is one more day pending. TRV validity only matters when you are travelling out and coming back in to Canada. Since you can legally stay in Canada based upon a valid study permit as long as it is valid. TRV is only required to reenter Canada which you can obtain any time again while being here on study permit. However, obviously this does not apply to some one on a visitor visa since the only legal ground for him to be in Canada is visitor visa.
