It could be either way. Generally people don't have to worry about this because sponsorship is a much longer process. I believe there is a way to ask for medicals to be given from inside Canada but you have to check details from CIC for that. Why can't you call CIC helpline to ask for that.

Hello All,

Anyone can guide me in this situation.

I dispatched through normal TCS my passports and it was delivered on 9th Sep at CHC Isb. and still I am waiting.

Gerrys is taking only 7-10 days, and my friend got the passports in this time. I am worried about my passports.
I had sent multiple times emails on london as well as on Islamabad address.

Did you make case specific request? That is an option on the CIC Islamabad page. It has fields for your proper identification.

Hi all,

I need some suggestions and a way out, kindly help.

I want to go on a trv and marry. My spouse-to-be is a Canadian citizen and works in Toronto. I also have a close aunt and cousin very well settled in the city who will provide me with an invitation letter and accomodation. However, I have read and heard that writing marriage as the purpose for trv gets it refused straight away, is that true? If yes, what can be a good alternative reason/s which will get my application passed? A story that will sound believable and will allow me to stay there for at least 2-3 months in order to get the marriage registered and obtain a certificate for it.

My personal circumstances at the moment are:
1. I live in pk at an apartment with my mother, ownership is joint
2. I am currently unemployed and mother receives government pension
3. My only sibling, an elder brother, is well settled in England and will generously help in my bank statement
4. I was legally studying and living in England for about 4 years 2010 onwards and am accordingly a postgraduate
5. I have travelled to Central Asia and Eastern Europe too

@SAAG, i don't know how to put this mildly. But so far, the kind of info i can provide is only limited to situations when you have a genuine situation and intent. If i were in your Spouse to be's position, i would get marriage registered and apply for inland sponsorship (though i am not sure if in land application is possible in this situation or not, but i would find out). The i could apply for SOWP / resident trv for wife.

I won't try tricking CIC into visiting Canada and getting married there latter even if i already have visa.

As far as I have read and searched, it is legal to marry in Canada on a student, trv or work visa so it is not that I will be doing something against the law therefore I believe in land sponsorship application will be possible although I might not be needing it and may well choose to return to pk and wait out the time period here, I am more concerned about the the first step at the moment and ideas regarding getting there, anything that comes to your mind given my circumstances, a solid reason to stay there for a couple of months?

To clarify, why do you think will it look like an obvious trick? According to my understanding, the permission and allowance in their law is specifically because of such a scenario i.e. a tourist goes there, likes someone and decides to ask for the hand in marriage, no?

If you give the real reason, they would refuse because to them, the appropriate way is to get married where you both can currently live and latter apply for your case.

To them (and to me as well) it would be unjust to all those people where one spouse was canadian citizen or resident and the other one waited back home for 2-3 years to get the sponsorship through.

Technically as of today you do not have a relationship that qualifies you for even a visit visa.

Permission in the law is for rare exceptions when your primary intent before leaving / when applying for visa wasn't getting married and it actually materialized while being there.

Lastly, i am not 100% sure, but if i remember correctly going out of Canada while your in land application for Spousal sponsorship is in process is a major risk to application. Perhaps you can further verify.

My advice would be to get married in home country or over the phone and apply through proper way.

If you are not interested in being present in Canada right after marriage, then it shouldnt be a big deal to wait in home country while your Spousal sponsorship is processed.

I have seen many cases go wrong in this kind of situations and it is always best to take the most genuine route. It might be a stronger case if say you go there on a study visa and then get married. But again i would stick with the genuine intent statement.

You are correct, I cannot leave the country after an in land sponsorship application is filed but like I said most probably I will be returning to pk and then the sponsorship will be filed in the 'out of country' category.

A Canadian student visa is obviously the best option but it is a little expensive, something I cannot afford as things stand. I do not want to get married over the phone and doing it in pk is again not cost effective because the people who will be in attendance (from mine and her side) all live abroad, if anything it will be more costly for me to do it here.

In summary, you think I cannot get a trv in any way under my circumstances? How about if my spouse-to-be and I do it in England? Do such examples exist?

Err - no i didn't say you don't have a chance of getting visit visa. I just said stating 'intended marriage' as a purpose would surely get a refusal. and I meant to say it will not be the correct reason morally.

If you have had traveled before / lived in Europe and you show a reasonable backing of visit, you might actually get it. It all depends upon how strong ties you have with home country, what kind of purpose of visit you put in, assets etc., what you do in home country.. the list goes on and i would say in general there is a good degree of scrutiny on visit visas from Pakistan.

Still people do get those so there is no harm in trying.

you have mentioned 'what kind of purpose of visit you put in' , that is the whole dilemma as we have discussed. I am assuming you have already looked at my circumstances?

I have also heard that if a trv gets refused then the sponsorship application case also becomes weak, they scrutinize more, is it true?

Lastly, what is your suggestion for me and spouse-to-be for getting married in the UK and then filing an 'out of country' sponsorship application either from england or pk?

Dear waqar.ahmad150, fkl, and others, First, i really wanted to appreciate your time and helping out Pakistani Peoples, your time is really worth for us,
i am now at the confusing stage, i hope you both guys have your best suggestion towards my queries, as my spouse have valid study visa, and i wanted to accompany her, what you guys suggested, Should i go for TRV or Open work permit ? I see here lot of refuse cases in TRV,i have make mind for open work permit but i am eligible for applying ? or is there any risk to apply on that too ?, because i am applying after spousal visa, also We both have good past travel history together, or should i go for TRV and Apply Work-permit At POE ? Possible, i really need your best suggestions, your response will be highly appreciated,
