Dear senior members,

I have a friend who is going to re-apply under the FSW NOC stream. He applied in MI-3 under the NOC 1122 – Professional Occupations in Business Services to Management. Unfortunately, quota was filled very fast and his application was returned. He wants to reapply under the same NOC in July 2012, if the NOC list doesn't change. Other than this he has never applied for Canadian visa of any kind.

My question to you is, in Schedule A Background/Declaration form, there is a question number 6, which requires a Yes/No answer.

6(d) been refused refugee status, an immigrant or permanent resident visa or visitor or temporary resident visa to Canada or any other country?

6(e) been refused admission to, or ordered to leave, Canada or any other country?

What should he write for these questions? I mean he did apply before but the application was not processed as quota was filled, so is it still considered as a refusal, and should he check the answer to both questions as 'Yes'?

Further more, if he choses 'Yes', then how should he explain it in the details section of question number 6.

I think NO is the answer inboth cases...Coz his application was received but didn't filed..so it's not a case of refusal.

hi munnabd,

seems you & me are in the same boat.....waiting for updates.....anyway in my point of view ans. of 6[d] would be YES & in description point you would describe the matter.....cuz as far as I know CIC at least have a document about not receiving your letter for reaching capacity & of course your friend already paid the initial amount to CIC for applying, they obviously have that document.....so it would be wiser to be honest.....& the other ans. would be NO of course.

It seems applicable only for new applicants........what about changing old passport to new MRP??? Have you any idea???

Is there any problem if i do not mention my old manual passport number during applying for new MRP.
The point is that i have sent photocopy of my old passport to CIO and SVO.
Eagerly waiting for your invaluable advice.

Thanks Ekarus...i thought the same thing initially. Other members in other threads said otherwise. Their reply is a unconflicted unanimous 'No'. As technically it was never processed. Case has to be processed to be rejected. Anyway, it would really help if someone had some personal experience or knows from a friends' experience and would share their experience. forcabarca86 has personal experience and says 6(d) and 6 (e) both should be answered 'NO'. That's what he did.

Anyway, I am inclined towards suggesting my friend 'Yes' for 6(d) and 'No' for 6(e) just as you think. But I would also like to get more inputs from other members. VOs all over are very strict and the slightest mistake can lead to rejection....there's no room for error anymore.

NO. Not now. it would be too early if you ordered the CAIPS now.
Wait 4-5 months to order the CAIPS. many assuming that something is gonna happen for MI-1 applicants before June 2012.

People are talking from pure absurd assumption.
ONCE APPLICANT IS SELECTED FOR AN INTERVIEW, THEY CAN TAKE MORE THAN ONE. INTERVIEWS NEVER GET WAIVED.

it would be wiser if you mention your old passport no. for new MRP.....cuz that will skip your pain of police verification....& other document verification......it would be a must if you have previous visa of any country that is tagged in your passport......at the time of applying just mention that you need your old passport back....then they will attach your old passport with your new MRP.......no worries......

The answer to both questions will be undoubtedly NO. It's just common sense. Applications 'returned' and 'refused' are not the same. If CIO returns any file, no documents are retained.
