Thanks so much for your quick reply. Actually I got married after my visa application was filed, that means I got 67 without counting my wife’s education. Still I have 67 without the adaptability.

At present we are living separately and unfortunately we are awaiting divorce. But it may take 1 week or may be few weeks.

Can I send a Separation Certificate? But I am not aware of such thing. From Where I can get a separation Certificate in BD. But is that enough to avoid interview? Please advice me in this regard.

It is difficult to get a written statement from my wife that she will write that she would not go to Canada with me and we are living separately, because the situation is not that much in favor of me. But I can give a try.might be successful.

My Statutory Deceleration has not yet reached the VO.I was trying to track it.

Please give me your valuable opinion. I am at a loss….

Here is what I have analysed about your issue.

According to section 77 of the Immigration and Refugee Protection Act, the principal applicant must meet the criteria for permanent residency as a skilled worker both at the time of filing the application and at the time that the visa is issued.

This is extended to the time of port of entry examination, according to s. 51 of the Immigration and Refugee Protection Regulations. Section 51 says that a foreign national who holds a permanent resident visa and is seeking to become a permanent resident must, at the time of their examination,

(a) inform the Visa officer if:
* (i) the foreign national has become a spouse or common-law partner or has ceased to be a spouse, common-law partner or conjugal partner after the visa was issued, or
* (ii) material facts relevant to the issuance of the visa have changed since the visa was issued or were not divulged when it was issued; and
(b) establish that they and their family members, whether accompanying or not, meet the requirements of the Act and these Regulations.

This rule is emphasized in the Operation Manual for Port of Entry Examinations. The manual says that when an applicant in possession of a permanent resident visa applies to become a permanent resident at a port of entry, the roles of the Border Services Officer at Immigration Secondary is to:

- ‘confirm that the applicant's marital, common-law, or family status has not changed since the issuance of the permanent resident visa' and
- ‘confirm that the applicant and their family members (whether accompanying or not) still meet the requirements of the class of permanent residents under which the permanent resident visa was issued.'

According to a CIC Call Centre Agent, all of this means that if an applicant‘s spouse or common-law partner is no longer accompanying them, then any points that they may have received for their adaptability cannot be counted.

When the principal applicant comes in for landing - the officers will verify that everything is the same as when the application was approved.

If it is not, the border officer will file a report and a decision will be made.

Under these circumstances, your visa would also not be valid, as upon arriving at the port of entry, you would have to disclose that you are no longer a spouse of the principal applicant.

I hope you score more than >=67 without your spouse.

This is the landing requirements for a New PR holder.

I hope your document soon reaches in CHC Singapore. according o EG7 this will delay your case but you can go for doing the Medical alone. you dont need to ask your being ex wife(!) to write a letter for you, people getting a divorce don't do that. once the VO gets your letter about your divorce, things will be dealt well by him; he will re prepare the legal papers for your file and send the PPR for you only accordingly.

My Name is Sujana Karim Susan ( 31 ) . I passed CSE ( Computer Science and Engineering / 04 year study ) from a private University last 2004 and then completed MBA ( Major Management / 3 semester i.e. 01 year ) as well .

I got a job an Inspection company as IT Executive , this company work for Marine, Automobile , Property ( Factory, House, Warehouse , Apartment , etc. ) survey and clime insurance if any damage or lost during policy period . While I did IT job and similarly I working with Insurance clime department ( Becoz of extra benefit) . This company computer LAN ( Local Area Network ) system I implemented 2006 and so far it is running smoothly if any problem I solve as well . But since March 2007 I mostly serving with Insurance claim department and my boss advise me to look after the department and issue a transfer letter as Executive ( Survey and Clime ) .Still it is continuing and now I'm Sr. Executive ( Survey and Clime )

My Job Duties : While any damage or lost automobile , marine ( specially container ) and property , then survey and make claming report on behalf of our client . I work with Fire department ( cause of fire ) , Health department ( specially doctor if any injury or death ) , Police department , Land valuation company , Environment Dept. etc. We help the client to get insurance coverage money ( 100% or partial )

Our client is Insurance ( Janata, Reliance , Federal etc. ) , Bank ( AB, Prime , NBL, SouthEast etc. ) , Shipping Company ( APL, K-Line, OOCL etc. ) , Land and Home developer , Vehicle owner , Transport company ( Green line, Shohag etc. )


It is Govt. registered Survey and Inspection company . w/o our inspection report Insurance company not pay the policy amount .

My Husband is MBA ( IBA DU ) / 35 age / serving as a Manager in a MNC .

My Paternal Uncle live in CANADA since 1998 and holding CANADA Passport

Please advise me I can apply the NOC 1233 my education is ok or not , what Point I got as above . What IELTS score I need ??

1. Go to the following link and find out whether your or your husband's profession falls in the listed professions, whose caps are not filled up yet. If so, you can apply under FSW 1 category.

2. If your husband or you have arranged employment, then you can apply under FSW 2.

3. As your paternal uncle is a citizen of Canada, you may apply under other category. I 'm not sure about that. Others may comment on it.

Is it necessary to take my spouse with me initially? My wife wants to go there later...maybe after 1 and half year when I'm settled...What are the rules regarding this?

Thanks for your opinion but things are different for this applicant. It is not clear whether this applicant will accompany at the time of landing/ or never willing to accompany in Canada or not even if the spouse land never in the future. If It is the case that the spouse accompany later/ land in future/ and included in the application, then s/he must go for the medical examination.Though this applicant didn’t mention about the divorce/ separation but the explanation from some of the member's ace regarding the issue is surprising.

If we take that applicant get separated or divorced, and then the principal applicant cannot claim those adaptability points and those points will not be awarded too. But it is seen that this applicant is sent medical request , obviously s/he passes point test for the eligibility .If he/she inform the visa office of the separation or divorce , the VO will go for re-consideration and withdraw the medical request .The outcome may be time consuming , delay in case processing and a possible interview ahead.


The visa office may ask an explanation from the applicant .The visa office may also request additional papers such divorce/ separation docs and other related documents before issuing further instructions or case processing.Please note that we must follow the golden rule of the visa office. Do not send documents or papers not requested by the visa office. The more the volume of documents and additional information, the more will be the tasks for the visa officers from the applicant.

Dear

It will not lead to the rejection . But ensure that you inform the visa office of the previous application or student visa application . otherwise it may lead to the case as "misrepresentation ".

your visa will be valid for 1 year from the date of Medical test completion. Your wife must land in canada before that date.
